That's why, in the US, if a student has an IEP the teacher (and subs) MUST know about it. For example, years ago there was a kid in Southern Missouri who had an IEP that stated he was not to be let out of his classroom alone. The sub wasn't given this information. - inactive, on 06/24/2009, -1/+21OK, I was not happy at all with the Stallworth plea bargain, but everyone seems to have the facts of this case misconstrued, so I'll try to explain it.
There are a number of reasons why Stallworth was sentenced to only 30 days in prison, 2 years of "community control" which is basically "community arrest" instead of "house arrest," 8 years of probation, a lifetime suspension of his driver's license (suspension can be reviewed after 5 years and Stallworth can possibly retain his license for business purposes only), and an indefinite suspension from the NFL.
First, and most importantly, there is security camera footage of the victim, Reyes, jaywalking in an area that was not marked by a crosswalk. This video gave the defense a huge amount of leverage because they could then present the argument that "anyone could have hit Reyes since he was illegally crossing the street in an area that was not designated for pedestrians." This argument creates reasonable doubt. I think this was ***** because Stallworth's BAC was .126 (legal limit .08) and a DWI is a DWI in my opinion, but the defense is technically correct, which is the best kind of correct when dealing with the law.
Second of all, this video pretty much destroyed the prosecution's chance at getting a manslaughter conviction (which is what Stallworth would have been charged with, not murder) so the prosecutors had little choice but to arrange for a plea bargain, or face losing the trial and Stallworth getting off with no punishment.
Third, an undisclosed, but I'm assuming substantial amount of money was paid to the Reyes family from Stallworth. Now I know the idea of trading someone's life for money is disgusting, but the swift payment of significant money to the Reyes family likely reduced significantly their desire to see Stallworth sentenced to the mandatory minimum term of four years, which would have resulted from a DUI manslaughter conviction.
And that’s not a slam against the Reyes family. It’s a comment on human nature. The desire to extract a pound of flesh tends to dissipate after receiving 20 pounds of cash. - itlnstln, on 06/24/2009, -3/+23I read the first sentence and that was all it took for me to digg you down.

Who would expect a student to rape her? If she had been warned that a particular student is dangerous based on his past actions, then she could have watched out for him and avoid being alone with him. So yes, the school failed her. I was ready to say the school wasn't at fault until I read that they knew this kid is violent and said nothing.
