- okayokayokay, on 06/27/2009, -0/+69"Seemingly" kicked? There's no "seemingly" about it. That cop PUNTED his head.
http://blogs.laweekly.com/ladaily/crime/das-boot-e ... - AmnesiacJack, on 06/28/2009, -2/+42What I love about the justice system is that if you even so much as scratch a cop he can charge you with assault (I saw it happen plenty of times to shoplifters who thought throwing a tantrum would help). But when we catch them on video kicking a man in the head they have to investigate and bring the FBI in just to figure out if he really kicked him or not?
If this was the other way around and it was the criminal kicking the cop in that video he'd already be prison. - smacksaw, on 06/27/2009, -1/+39I think the real story in there is the cop selling gang-style t-shirts. This guy had better double his hopes for protective custody when he goes to jail for kicking a man while he is down.
Not only should internal affairs be run by independent citizens, but I think we should have a say in the hiring process as it seems there are some gaping cracks that bullies, hypocrites and jackasses easily slip through on their way to being sworn peace officers.
This guy sells crap that glorifies gang life? Yeah, I'd love to have him as my partner. - motivatedguy, on 06/28/2009, -5/+39I'm so sick and ***** tired of hearing this argument, "But, he could have killed someone!". Guess what? HE ***** DIDN'T!!!! Our system is designed to punish people for the things they do. Kicking a man in the head while he is laying on the ground is *****. You're a police officer and held to a higher standard than the rest of the public. Police officers are paid to keep a cool head in stressful situations.
- Shaggy6ster, on 06/28/2009, -1/+35"The officer potentially risked his own safety by not waiting for back up before approaching the proned out suspect, and then risks losing his balance by kicking with gun in hand"
Well when you put it that way, the real victim here is CLEARLY the cop. I mean, he could have broken his foot, too! - inactive, on 06/28/2009, -1/+31The guy may be a dirtbag but he obviously surrendered that kick to the head was just simple brutality.
- clvngodess, on 06/28/2009, -0/+29The cop AND the gang member (alleged my ass) are both douchebags. However, I've seen the video, the cop ***** up.
- inactive, on 06/28/2009, -1/+30I don't know what's worse, the fact that such a thing happened or the fact that I am no longer surprised by such disgraceful acts?
- twiztidsinz, on 06/28/2009, -1/+19The thing that a lot of people don't seem to realize is, just because you condemn a cops action(s) doesn't mean you're approving of the suspect/criminals actions.
The guy deserved to be taken down, by force if needed, because you're right.. he COULD HAVE killed someone.
But he didn't, thankfully.
He had laid down, on his stomach, in a spread-eagle position and surrendered.
It was over.
He knew it, the cop knew it
The cop just wanted to show what a badass he was. - overtoke, on 06/28/2009, -3/+21they get investigated, but they don't seem to get charged for the crimes they commit.
+ stop being a dumbass - marmotjmarmot, on 06/28/2009, -10/+27***** THE POLICE.
- marytormey, on 06/27/2009, -2/+16You don't know how things work, police are above the law. They will just keep him at a desk till everyone forgets what he did and then put him back out on the streets with a gun.
- ChadN, on 06/28/2009, -1/+13No, he *deserved* to get kicked. But "deserves" got nothing to do with it; cops have to operate with some restraint, even from ***** like the one he booted.
- galore, on 06/28/2009, -0/+12so, now the basjij are the "standard" to compare to ?!
- wissler, on 06/28/2009, -0/+11I guess that's what it takes to be a journalist nowadays. You have to be a know-nothing. It's "bias" to actually report what actually happened.
- MarlinFF, on 06/28/2009, -2/+11Okay - I don't think anyone said that the gang member did not deserve that kick to the head... and even more as you stated.. But the thing is the cop used unnecessary force even though it was very blatant that the gang member poised no harm.
The reason why this is being we are decrying this is because they are NOT above the law. - rangah, on 06/28/2009, -0/+9No, the jury need not take into account your opinion of this criminal. It is NEVER the police's job to mete out punishment. EVER. Under ANY CIRCUMSTANCES. That is why we have a COURT SYSTEM and JURIES.
He shouldn't just be fired he should be charged with felony assault. (Committing an assault while armed with a gun is an automatic felony) - teamgwho, on 06/28/2009, -0/+8suspect was guilty and deserves jail .
cop was wrong for adminstering his own justice.
just because I believe the cop was wrong to use excessive force doesn't mean I think the criminal shouldn't have to answer for his crimes. they are both guilty. - forand, on 06/28/2009, -0/+8I doubt they "brought in the FBI." I suspect the FBI came in since the suspects civil liberties were blatantly violated by the police officer.
- Charun, on 06/28/2009, -1/+9Cops don't decide what you deserve. We have courts for that.
- teamgwho, on 06/28/2009, -0/+8The government (all forms of it from cops to judges to politicians) need to be an example and follow the law. If the people in law enforcement can't follow the law, then why should any of us? A person is innocent till proven guilty. Once found guilty they are punished by jail or fines or whatever manner is decided by the judge. a cop is not there to decide anything, let alone dish out punishment.
The jagoff needs to go to jail for his dangerous driving.
The cop dishonored his badge and all members of the police force by failing to restrain himself and follow procedure. He should be fired and charged with assault because his actions were uncalled for. You don't purposely assault a person who has surrendered. Period.
most people are good. This douchebag driver is an exception.
Most cops are good. This cop is an exception. - kdmkdmkdm, on 06/28/2009, -0/+8^ALL CAPS IN HONOR OF MAYS!
- bugwayji, on 06/28/2009, -2/+9 Dictator supporter in training? Just in case reality has any room in your world, the crime rate in the U.S. has been falling for years.

I get a kick out of people who carry on, then one day they or someone they know gets the goon treatment, and all of a sudden they clue in. - MarlinFF, on 06/28/2009, -1/+8How is that cop enforcing the streets and in his private life promoting gangs through his clothing. I mean in many careers, what you do during your private life DOES affect your career.
- DankBuddz, on 06/28/2009, -0/+7Huh. So I wonder why gang members keep perpetuating a 'cop-killer' mentality.
- pendrachken, on 06/28/2009, -1/+8No, actually you are at the top of MY list, lay down please.
- piieerrrree, on 06/28/2009, -0/+6THE DUDE LAID DOWN AND SURRENDERED, PROBABLY THINKING HE WOULDN'T GET KICKED IN THE HEAD
IF EVER HE'S ON THE RUN FROM COPS AGAIN, DO YOU THINK HE'D RATHER LAY DOWN AGAIN AND RISK GETTING KICKED IN THE HEAD OR TAKE OUT A GUN AND START SHOOTING ***** UP?
YOU SHOULD TAKE IT IN CONTEXT. - wassamatta, on 06/28/2009, -0/+6He's just an entrepreneur... with a badge and a gun. Which also violates most PD rules as cops aren't allowed to 'moonlight'. Someone correct me if I am wrong.
cop = douchebag
gangster = douchebag and will probably get shanked in prison.
What if it wasn't a gangster? Could have been a crazy housewife or pissed off husband that had a domestic dispute which lead to car chase. Would the housewife or husband deserve a kick to the head? What if it was a teen on a joy ride? Or someone taking psychotropic drugs and went a little nuts?
Point being.. cop screwed up and should lose his job over it.
Mr. Gangster will not get millions.. I doubt a jury would award him that amount of money with his history. He'll probably get a couple of hundred K if he is lucky. - milkmage, on 06/28/2009, -1/+7do you know what vindicated means?
the perp will not walk for what he did, but the cop may face charges in ADDITION to the suspect. - Obsession88, on 06/28/2009, -0/+6alleged gang member...
- overtoke, on 06/28/2009, -0/+5more cop excuses...
- KarenRice, on 06/28/2009, -0/+5Here we see the fruits of movies like Dirty Harry. Yes, I loved Clint, I loved Harry. He only hurt the bad guys, the scum. Yet....he still operated outside the law. Dirty Harry was a bad cop. Yes, I certainly would feel safe, myself, if cops like Harry were around shooting rapists and beating serial killers to death - but in the movies you know the guy is guilty as sin. And actually I don't know that Harry ever beat someone who actually surrendered...but I digress....
In real life, we have a criminal justice system for a reason. Unfortunately our criminal justice system sucks; bad guys get off on technicalities or have reduced sentences....but it is what we have. - RatatRatR, on 06/28/2009, -0/+5So what?
- teamgwho, on 06/28/2009, -0/+5way to cut/paste from the comments on the website verbatim.
plagarzing someone else's internet postings?
wow you really are a moran. - pagno, on 06/28/2009, -0/+5This same argument is used to empower cops like the one in the article.
- Charun, on 06/28/2009, -1/+6People who do the right thing don't have to worry about getting "caught at it."
- inactive, on 06/28/2009, -2/+7Nothing will happen to this joke of a cop. Even if he's found guilty, he'll just have some ***** verdict, like 2 months without pay or something. It happens all the time.
- Zarchon, on 06/28/2009, -0/+5Two points I would like to make. One, Scum like this gang banger need to be off the street. Second point, Cops like this guy need to be taken off the street. It isn't a "one guy is bad and one guy is good" scenario. This guy was a crook. He needs to go to jail. The cop is there to take him into custody so that he can be put in jail. Anything the policeman does other than apprehend this guy is an abuse of power. I don't deal with crooks very often and on some of the occasions I do I have the opportunity to defend myself and deal with the situation. When I have an interaction with a cop I have no option other than to do whatever he wants. He doesn't serve me, he isn't looking out for my best interest. When my car was broken into outside my store, the responding officer asked what I was doing at my own store after business hours. Cops need to be held to a higher standard, not allowed to break the law when they feel like it. In Orange county they give cops little sticker badges, two, to give out to family members. Those family members will no longer get traffic tickets. Favoritism needs to stop. Police need to be held to the same standard as everyone else, maybe even more so.
- RatatRatR, on 06/28/2009, -0/+4"there would be a lot less people engaging in high speed pursuits if they new that this was going to happen."
How do you figure? People are running from the cops because they already know that some seriously unpleasant ***** will happen to them if the cops catch 'em. - thesonofdarwin, on 06/28/2009, -0/+4Is internal affairs doing this? You know, that cop-run institution designed specifically to investigate and prosecute those officers who commit crimes. No? Oh... you had a point though, right?
- Napiertt, on 06/28/2009, -1/+5Yeah, bury your head in the sand. Cops can do no wrong. Until one day when it's you or a family member who's abused by some jackass in uniform.
- mloiterman, on 06/28/2009, -0/+4While I agree that the gang member is human garbage, the idiot cop didn't do anyone any favors by kicking the guy after he surrendered. Instead of going to jail, he'll likely sue for police brutality and win a large settlement with the city.
- teamgwho, on 06/28/2009, -0/+4I guess it's ok if the cops kick you too then? cause it's ok to abuse power right?
- inactive, on 06/28/2009, -0/+4C'est Vrai.
- teamgwho, on 06/28/2009, -0/+4@ FuZi0nDET
yeah, why bother with courts, evidence, trials, due process and so on... just let cops be judge jury and head kicker. that'll solve evvvvvvverything. - twiztidsinz, on 06/28/2009, -0/+3@RatatRatR:
The same way that telling kids not to have sex stops them from having premarital sex. - Krakerjax, on 06/28/2009, -5/+8Justice is justice, if you give it to some, you have to give it to all.
- RatatRatR, on 06/28/2009, -0/+3Yeah, how dare he look that way?
- smotpoker, on 06/28/2009, -0/+2I doubt "Digg" told you any such thing. "Digg" very likely told you that cops protect each other and that's largely why they never get punished as much as regular citizens for the same offenses but that's about it.
Yes, when there is incontrovertible video evidence and media attention there is usually some form of "investigation" and *maybe* some form of disciplinary action. However without video footage there is almost never *anything* done and even with it there is very seldom any real disciplinary action (ie beyond being desked or suspended with pay), few criminal charges and even fewer convictions. - charlie6969, on 06/28/2009, -0/+2AMEN!
Just because we don't want our police beating people whenever they feel like it, doesn't mean that we are hollering about the beatee being innocent.
We just don't like violence above and beyond what is called for to arrest someone. (And I would say kicking the guys head while he is laid down and submitting is abuse of police power.) -
