Doesn't even have to show that he tried to use a places facilities. He could simply drive by, notice lack of handicap parking and sue and often times it's what he does. My dad owns some old property, built before ADA passed, that he targeted. This property housed old businesses that were barely successful and in some cases total dumps. He was not a visitor, frequent or infrequent to these establishments. Of course, it doesn't matter. No warning, no suggestion to build accommodations. He got a thousand dollar settlement from us because it's much easier and cheaper to just pay him to go away then to engage in a costly trial. It's total ***** what he does.

This isn't advocacy. This is just two greedy people taking advantage of a legal loophole. I highly doubt he ever intended go back to these businesses even before he found a problem with them. This doesn't fix the problem. This only elevates animosity towards a much bigger group who are tired of being associated with these old and ugly stereotypes.

After all if someone violates the act the problem isn't for Bundy or any single individual but rather any disabled person who legitimately wants to use the premises. So why give money to an individual.
With fines people can still make complaints and advocate, however there is less incentive for abuse. It can also mean money raised from fines can go towards funding the administration and help improve access for all disabled people rather than into a pocket of a single individual.

Am I entitled to anything? No! REASONABLE accommodations are necessary to a point. This guy disgusts me! The world is not fair.. do fat people have the right to sue a store for not carrying their size of clothing (obesity is a recognized health issue) ?
I hope actions are immediately taken to correct this loophole. If you have a ramp, it won't be the right size. If you have a ramp the right size then they will find something else. He basically sued the entire town of Julian. But he got hit with frivolous lawsuit clause. What he does now is hire disabled persons to go to establishments and gives them a "cut". He's pathetic.

We sell tropical fish to pet shops, and one of our customers renovated the second floor of his shop a while ago. Just when he was ready to move in the tanks, somebody suspiciously similar to the guy in this article complained to the city because the top floor was not wheelchair-accessible. In the end, the city ruled that unless the owner installs a prohibitively-expensive elevator, he can't use the newly-renovated space for retail. So now he stores boxes and stuff up there. It's probably not the same guy, but it wouldn't surprise me if it was. It takes a special species of slime worm to sink this low.
This sort of thing is just plain despicable. I don't care who you are, or how disabled you might be--if you sympathize with what this guy is doing, then you've got some serious entitlement issues, and I advise you stay away from my business lest I show you the true meaning of a difficult life. The most dignified and respected handicapped people I know are the ones who don't let their condition get in the way of living out their lives, and who don't feel that other people should suffer just because they themselves do. What this guy is doing is purely extortion, and disabled people should be mortally offended by it. It's stuff like this that creates a stigma for the physically-challenged, and if we keep rewarding it by allowing it to continue, after a while perhaps we deserve the consequences. If we let any minority that screams loud enough get whatever it wants, then eventually we reach the level of this slimeball.
I'm not trying to be cruel, only realistic. I understand that there are hundreds of thousands of physically-challenged folks out there, and I am sure the overwhelming majority of them will be the first to tell you what this guy is doing is disgraceful. My only hope is that he is equally reviled by what remains of his family, and that he will eventually die alone, miserable, and in extreme pain. Sometimes wishes come true; we can always hope. -
