A person has to have complete control of their faculties to be tried. When you are asked how you plea, the following question asks if you have, in the past 24 hours, done any drinking or used any drugs. If you have, the court is legally unable to accept your plea. So, if you show up to your court appearance with alcohol on your breath, you just wasted the court's time and money. I'm not saying whether or not I agree with this, but its the way it is.

- smotpoker, on 05/17/2009, -4/+7I saw some officers and judge lock this one guy up for contempt because he had alcohol on his breath. As soon as he admitted to having a beer when they asked him, they put him in cuffs. When the judge came out and found out why she sentenced him to 5 days over it.
I forget what he was there for originally (if I ever found out) but thought it was kinda messed up... alcohol is legal, he wasn't stumbling around or belligerent and he didn't have an open container in the building or something. I suppose drinking could impair one's mental faculties to the point legal decisions/agreements might be called questioning but not from the one beer he admitted, he wasn't drunk enough to be obvious and they didn't give him any tests at all.
Seems to me like contempt charges should only apply when people are intentionally insulting/disorderly/disobedient, not because they refuse to partake in arcane rituals or do things they are legally permitted to on their own time. I smoke a lot, but it hasn't dulled my senses enough to know that (un)wittingly carrying 2oz. into court is really ***** stupid. While I can sympathize, it makes me wonder just what else this dim-witted attorney has overlooked in her career.
