When I go to 7-11, sometimes my slurpee is 1/4 gone by the time I leave. How can you demonstrate intent to steal if the person hasn't even left the store yet? - fani, on 04/03/2008, -1/+10Damn, its really much better here in America then.... I was shopping with my wife and kid at Sears. We had a phone in the shopping cart when my daughter (who's 20months) decided to run to the other store because it was KBToys.
In our anxiety my wife and I ran out with the shopping cart to the next store. A few mins later, we realized that we didn't pay for that phone in the cart and we were out of the store. I went back and paid for it and explained to store guy what happened and that I mistakenly walked out with their phone.
I don't know about the rest of America, but that actually made me feel nice since he didn't brand me a thief and check all my cart items or call the manager. What I find more interesting is that a major newspaper in Britain devoted this much coverage to a story that would bore me if someone told it to me at a party. She wasn't arrested or detained. Basically, they devoted a page of their paper to a story about a rude Woolworth's employee. I can't wait for next week's expose on apathetic Wal*Mart checkers.

In the US, it's not theft until you show intent to not pay, like leaving the store. It's perfectly legal to consume something before you pay for it. I've done that with sodas alot. Grab one on the way in, drink it while shopping, hand the empty/almost empty bottle to the cashier to scan in. It's perfectly legal, its not really any different than eating your meal at a restaurant before you pay (the norm) ... - inactive, on 04/03/2008, -1/+8She didn't "let" her, she was just out of the mother's sight for a second. She did not condone her daughter's action either. She simply thinks a scolding was not deserved for a 2yr old stealing a single piece of candy and eating it, which her mother then paid for after the employee rushed the thief (her daughter).

In fact, I was all ready to side with the mother, until she basically said that she had no intention of paying for the item. Reading between the lines, it sounds like the kid grabbed the stuff and the mother saw it and kept walking for the door. I don't know whether the store associate went overboard or not, but from reading the article, the mother was not planning on paying for it unless she was asked to...

A simple "Your daughter ate a piece of candy, you'll have to pay for that" would have sufficed. Nowhere in this article does it suggest that the mother or anyone else condones the actions of the kid, or that the mother should have gotten away without paying.
