Nine months to a year later (depending on how long she waits) and, bam, FMLA leave and job protection.

They can say I can't live somewhere if I'm under 55, yet I can't say I won't hire them for being over 55 nor can I run an advertisement to rent out my home to someone under 55.

I need someone reliable in those positions, not someone who at any time can leave (even with the 9 months of notice) for 12 weeks, then probably only want to come back part time or with a very specific limited schedule (in my experience).

- Nayamina, on 08/21/2008, -0/+2I don't know about in the US but in Canada I believe the labour laws state something along the lines of if you're laid off, and your old position (or one similar to your old position) opens up you must be contacted for that job.

It's a federal regulation for compliance with age discrimination laws. I agree that it is discrimination, though. They are making certain homes unavailable because of my age. If somebody sued them, I think they would win.

Boo ***** hoo. For jobs and apartments and stuff it matters less, but every situation is different. I wonder if there will ever come a day when America can solve its grievances without suing left and right, it makes the country look like a bunch of snot nosed brat kids.

She didn't hired back -- So what? When they open up the position, they take all applicants. Maybe there was a more qualified person who worked for less.
She SAYS it's age discrimination, but she doesn't have any proof. No documentation or statements from her lawyer or the AARP are listed.
