oh God... - Ozymandias42, on 12/20/2007, -1/+40So here's my problem with this. Statutory rape is rape because the minor is considered unable to consent. They're unable to consent because they do not have an adult's comprehension of what it involves. Their minds are considered incapable of really understanding what they're agreeing to.
To charge them as an offender, however, it seems to me that they had to have been able to comprehend what they were doing. If it's impossible for them to fully give their consent, it must also be impossible for them to fully withhold their consent. This is exactly the same problem as when two people get equally drunk and have sex, and then one (or both?) of them is charged with rape, and it doesn't make any more sense here than it does there.
But the law's the law. It appears the Utah legislators did this on purpose, and if they want to change it, there's a procedure for it. If this is a travesty of justice and needs to be corrected by the governor, there's a procedure for that, too. If you don't like it, don't live in Utah.
Seriously, don't live in Utah. That place is crazy. Their biggest lake is salty! A saltwater lake! Nature says "Get it on!" at puberty. It's people/society/culture that says "Oh, Nature, lol!" and stops it.

I mean I've never been to the US, so I haven't experienced american education on this, but let me just say that merely mentioning the idea of abstinence as a form of education would get you laughed in your face in my country.
My first sex would have been a crime in your country, yet I have no children so far and I'm mentally quite healthy. Seriously though, if you re-read what I said... the point is that saying a 13 year old is not "capable" of having sex is like saying a 13 year old is not "capable" of drinking alcohol.
