That is why 3D Releams didn't cancel it (even though they wanted to). Because they would of been sued to heaven and back. Their loop hole (due to the legalize wording) was the "nah nada, you can't touch us; we are still "developing" this game". That has held up in court till now. It has taken forever, but looking at the demos, it's pretty obvious why. This was the next Duke3d. It wasn't just the use of the character Duke or the name. It was all the elements that made Duke3d a great game, such as the attitude, the environment, the weapons, the humor, the pop-references and the self-references.
In Duke3d there was a beginning level where you walked into a bar and you could actually play pool. On the TV was OJ Simpson, forever running from the cops. Then you walk to the back and there is a strip club where you can tip the girls or shoot them. The clue was in the title all along. - KaivenTor, on 05/15/2009, -2/+16Thing is, 3D Realms had 12 years. 12 years even if self-funded, they should have made something, a game, a demo level, something. Was everyone just working on this on the weekends? Also, with the release of various platforms like the Source engine or even Unreal's graphics engine, that could have cut their dev time down so that could focus on models, environment, gameplay, story, etc.
