O.J. Simpson's ghost writer calls him a 'murderer'
slate.com — "I was sitting in a room with a man I knew to be a murderer and I let him hang himself. There was talk he was going to do this as a straight confession." A working title for the book at one point was not 'If I Did It', but 'I Did It'. The title was suggested by Simpson himself. What do you have to do in this country to get yourself thrown in jail?

- whiskeymb, on 10/12/2007, -1/+52Simpson was already found not-guilty of murder. He can not be re-tried for that crime (in his case). So, he can admit all he wants to killing her and it won't matter.
The fact is that OJ Simpson will be put in jail for tax evasion before he ever gets put in jail for the murder of Nicole Simpson.- MattJF317, on 10/12/2007, -21/+4O.J. Simpson a murderer?

- T4z3R, on 10/12/2007, -6/+14I think he would be arrested for the confession, but he never took the stand so it wouldn't be perjury. The only thing they could get him for is a false testimony or something. Which is easy time.

A person can't be tried for the same crime twice *unless* there is new evidence discovered that was not previously available. I think a confession would be tantamount to having new evidence. - 4degrees, on 10/12/2007, -22/+76"What do you have to do in this country to get yourself thrown in jail?"

That's not true at all. You cannot be retried for the same crime after you're found innocent, except:
"There are two exceptions to the general rule that the prosecution cannot appeal from an acquittal. If the earlier trial is proven to be a fraud or sham, double jeopardy will not prohibit a new trial. In Harry Aleman v. Judges of the Criminal Division, Circuit Court of Cook County, Illinois, et al., 138 F.3d 302 (1998), an appeals court ruled that a man who bribed his trial judge and was acquitted of murder was allowed to be tried again, because his bribe prevented his first trial from actually putting him in jeopardy. The other exception is that prosecutors may appeal when a trial judge sets aside a jury verdict for conviction with a judgment notwithstanding the verdict for the defendant. A successful appeal by the prosecution would simply reinstate the jury verdict, and so would not place the defendant at risk of another trial." - thcobbs, on 10/12/2007, -6/+14@4degrees
No. To get thrown in jail you have to commit a crime and be really dumb about it. - danbuscaglia, on 10/12/2007, -0/+10Double jeopardy comes from the 5th amendment ("nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb.") In Fong Foo v. United States, the SC made it impossible to be retried for a crime you were acquitted of, regardless of new evidence. At first, this only applied to federal cases, but was extended to state cases (murder) through incorporation of the 14th amendment in Benton v. Maryland.

that's not it, it was the racist cop, just about every black person, myself included, has ran across a racist person of authority(be it cop, teacher, or bank teller) that you really can't do anything about, they probably let OJ go just to piss off Mark Fuhrman - parax, on 10/12/2007, -4/+5@Elranzer
Black jurors were important element in the case, only because they were able to sympathize with the potentially biased law enforcement.
If you think black people culturally approve of killing white people, you may not be a racist, but your knowledge level leaves something to be desired. He was acquitted for many reasons. Tantamount among them is that the jury became confused by ping-pong rulings. The jury was shown evidence that was later ruled inadmissible, hearing testimony that was thrown out, and hearing stories about evidence being tainted. At the end of the day, the jury probably couldn't keep track of which evidence was "real" and which evidence was ruled faulty. Most of the jurors probably could not say he was guilty "beyond reasonable doubt", even if they had strong feelings. The standard for a criminal prosecution is not "guilty because we strongly believe he did it"
Black people don't band together to make sure other people of the same race go free. We have just as strong moral convictions as the next person. It's comments like yours that broaden the racial divide. Black people are not so ignorant the only way we could possibly form a decision is if we just chime in with "whatever the black guy says I agree with." The jurors probably believed they made the best decision they could given the information available to them. - ray901, on 10/12/2007, -1/+2@parax

The juice, a murderer?! Nah........... - MrTRiX, on 10/12/2007, -0/+8Source en.wikipedia.org:
The phrase "double jeopardy" stems from the Fifth Amendment to the U.S. Constitution: "nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb." This clause is intended to limit prosecutorial abuse by the government in repeated prosecution for the same offense, as a means of harassment or oppression. It is also in harmony with the common law concept of res judicata, which prevents courts from relitigating issues and claims that have already been the subject of a final judgment.
There are three essential protections included in double jeopardy: protection from being retried for the same crime after an acquittal; protection from retrial after a conviction; and protection from being punished multiple times for the same offense.
This law is occasionally referred to as a legal technicality, because it allows defendants a defense that does not address whether the crime was actually committed. For example, were police to uncover new evidence conclusively proving the guilt of someone previously acquitted, there is little they can do because the defendant may not be tried again (at least, not on the same or substantially similar charge) Fong Foo v. United States, 369 U.S. 141 (1962).
Though the Fifth Amendment initially applied only to the federal government, the Supreme Court has ruled that the double jeopardy clause applies to the states as well, through incorporation by the Fourteenth Amendment. (Benton v. Maryland.)
Jeopardy attaches in a jury trial once the jury and alternates are impanelled and sworn in. In a non-jury trial, jeopardy attaches once the first evidence is put on, which occurs when the first witness is sworn.- dkm201, on 10/12/2007, -0/+1Damn you Fong Foo!

- erikf, on 10/12/2007, -9/+3OJ Simpson could have confessed on the stand in court, he still would have been set free for two reasons:
1)The state was terrified of the you-know-whos rioting and burning down their own communities, again, the 'hoods that whitey just paid for to be rebuilt.
2)He was set free because the jury had 8 blacks and 2 hispanics, an Indian and a white woman, and we all know only white males can be guilty because whitey is responsible for everything evil. - evil-doer, on 10/12/2007, -9/+5"What do you have to do in this country to get yourself thrown in jail?"

This case has very, very strange factors. OJ making a book -- and all this speculation that he DID IT -- is pure speculation because no book has been released.
This guy has no means to make a living and probably went with what he could go. Furman fked himself by getting caught on "TAPE" saying he sets up black people. As lead investigator, that's enough for me.
