- HunterTV, on 10/31/2007, -15/+333Wait a minute, I'm no lawyer, but prostitution is illegal, so doesn't that nullify any legal service liabilities?
Should be rape at gunpoint. - andycr512, on 10/22/2007, -0/+172Heard this quote on the internet a long time ago...
"If you rape a prostitute, is it rape or shoplifting?"
It was meant as a joke, but apparently this judge took it seriously... - penchant, on 10/23/2007, -20/+174Wow. Surprised that judge was a woman.
America's legal system has this funny habit of throwing out rape cases of any women who is deemed slutty, or works as a prostitute, or was drinking, even if the assailant has raped before.
According to the current justice system, men should not be held responsible in these circumstances, while women should. - Dysarthria, on 10/25/2007, -76/+209The lesson here is .... don't be a ho.
- inactive, on 10/23/2007, -9/+121Man, if they'd decided to off the hooker, would the judge have said the defendants were merely guilty of "Destruction of private property" and must pay damages to her pimp? That would be the logical progression of the judge's decision.
- inactive, on 10/24/2007, -13/+115*Surprise sex at gunpoint
- inactive, on 10/22/2007, -4/+98To loosely quote Axel Foley, "What do you call it if I get thrown out of a car? Jaywalking?"
- carpespasm, on 10/24/2007, -10/+99well in situations where it's consentual sex until the next morning and the girl decides she didn't like it and screams rape, the guy is likely to wind up in prison, so it's ***** for both sexes.
- pintomp3, on 10/27/2007, -7/+83just because she has sex for money doesn't mean she doesn't have the right to refuse.
- GeneralFailure0, on 10/23/2007, -9/+68Just because you agree to have sex for money does not mean that being forcibly taken in a situation that you could not control where you were made to feel your life was in danger is not a traumatizing experience and any less of a rape.
- bajesus, on 10/23/2007, -1/+43More importantly is that if you mention that you are female on Digg you are likely to be attacked in the message board equivalent of a gang rape.
- StarlessKnight, on 10/22/2007, -6/+48The actual lesson should be: Don't be a rapist. Unless you're trying to hold the moral high ground above the "ho."
- dtraneighty8, on 10/07/2008, -6/+45Three? don't be an optimist.
- inactive, on 10/22/2007, -9/+45YOUR MOM HAS THE WIT OF AN 8 YEAR OLD!
- lovecups, on 10/22/2007, -2/+36hmmm.... theft of services makes sense in a weird way...but I think that would be on top of the actual rape. He held her at gun point, and I'm sorry but someone shoves a gun in your face you will do to a lot of things you would not normally agree to. It doesn't matter her profession, or original willingness. No means no, no matter the person or circumstances. It's kind of like date rape at this point. And that has a precedent of successful prosecution. This Judge should be disbarred....come on now! It's her job to be impartial. If she was really doing what she should she would have convicted him of rape and theft of services and sent him to jail, and her of attempted prostitution and sent her to jail. Then all the bases would have been covered.
- nova912, on 10/22/2007, -5/+36Man... who ever that lawyer was is a genius and the devil, all rolled into one. I don't agree with it, but you have to admit that was one ***** up argument to try in court. "you can argue anything" still stands I guess, I could have never thought of this defense.
- Lennalf, on 10/22/2007, -1/+32What about that women who was selling her "services" on craigslist for WoW gold? I bet she's around here somewhere...
- ToadLeg, on 10/22/2007, -1/+31"But, she said it would cost a trillion dollars for me to have sex with her before I pulled out my gun and ra...stole some services"
- pintomp3, on 10/22/2007, -5/+31prosecuting the victim is a common tactic of defense attorneys.
- ogden, on 10/22/2007, -13/+39Thats because about 50% of the rapes reported in this country are false accusations. They are usually women seeking revenge or not wanting to admit they've willingly slept with someone after its been found out by a husband, boyfriend, parent etc. Its estimated that 50% of *real* rape crimes go unreported as well.
- llamaguy132, on 10/23/2007, -3/+28this is why prostitution needs to be legal, it will happen no matter what the laws are, but if its legal the women can be protected from this and other dangers like drugs and pimps.
Look at the bunny ranch, legal prostitution that is safe for all parties because they are protected by law and don't need to fear going to the police.
regardless of a womans personal choice to engage in this activity, is this the message we want to send to them? your *****?
what message does this send to people who use their services, they can do whatever they want to them? like there not even human? its like real life GTA, get a hoe, ***** her, then beat her to death for your money back. this is what this judge is promoting. - inactive, on 10/22/2007, -3/+27http://www.americandaily.com/article/5075

Saying half of all cases are false may be a little high, since a couple of these articles are putting that number in the low 40% area, but still, he was close. - rhylan, on 10/22/2007, -3/+27When its ajar!
- xerexes1, on 10/22/2007, -2/+26Are you deliberately ignoring the fact that she was held at gun point to perform sexual acts on these men?
- xGeneric, on 10/22/2007, -1/+24"America's legal system has this funny habit of throwing out rape cases of any women who is deemed slutty, or works as a prostitute, or was drinking, even if the assailant has raped before."
Uh huh, and then you have cases like the Duke lacrosse one where no one raped anybody, but they decided to take the testimony of some stripper with a shady story as fact. Wasn't just Nifong pushing it, the media basically wrote them off as guilty from the start as well. It would be naive to think this is an isolated case.
There's no one way bias throughout the whole country. It depends on what group of morons run the legal system in your area... You can either have the "She's a slut, she deserved it or she's lying." group, or the "Men are pigs, of course they would do that, and they did" group. Maybe, if you're lucky, you'll find a sensible judge... maybe. - ToadLeg, on 10/22/2007, -1/+22There was no transaction; She has no "right to refuse" once she's taken the money because then she's made a transaction, as a prostitute, obviously. She has the right to refuse if no money has been given because rape is illegal. Being a prostitute does not mean that anybody has the right to rape you.
- Steviebe21, on 10/22/2007, -3/+24She was forced to have sex...at gun point. How is that not rape again?
- s0nicfreak, on 10/25/2007, -0/+21Blowjob for $150? Someone's being overcharged...
- MrLeEx, on 10/23/2007, -18/+37"It's not rape. It's surprise sex."
- Kajico, on 10/21/2007, -2/+20It seems the judge's moral prejudices got the best of her. This a kind of double edged sword, on one hand, you're treating this as a business transaction, as what most advocates for legal prostitution have been trying to do for years, but at the same time you're talking about forced sex on a woman. Some would say if prostitution were legal and in a controlled environment, this could've been prevented, but on the other hand what would happen if the same situation occurred in a legal brothel? Is it still rape? or theft of services?
She should appeal the judge's decision and try to go to a trial by jury, because it's very obvious the judge was being biased in this case. - Zap2, on 10/22/2007, -1/+18True, but I think was rape.
He showed up, pulled a gun, and said have sex! If he had showed, shown some $$$, they had sex, then wiped out a gun, and said "no money for you!"..its be robbery, - buddhistMonkey, on 10/22/2007, -10/+24So, gang sex at gunpoint is considered "theft of service?" This judge needs to lose her robe (and not in a violent way, either).
- sensor, on 10/22/2007, -2/+16A bit offtopic but the "paragraphs" on that article are horrible. Very hard to read.
- LokitheComplex, on 10/24/2007, -3/+17Interesting that it was a woman judge.
Women are notoriously bad at judging other raped women. I heard of a situation in New York I think it was where a feminist had the laudable aim of pushing up the low rate of convictions of rape in the courts so they tried putting more women on the jury. Unfortunately the results were worse. It seems women judge a woman very badly that has been molested and seek to justify the man.
This value can be seen in the contempt a lot of women have for other women who dress in a sexual or semi naked manner. "That tramp was asking for it."
And perhaps men have a desire to punish other male rivals. - tech42er, on 10/22/2007, -0/+13A little humor in a prostitution/gangrape thread? That's a digging.
- inactive, on 10/22/2007, -3/+16*Gamer's TIP* If you beat her after she gets out of the car, you get you money back.
- ToadLeg, on 10/22/2007, -4/+16Every act of forced sex could be considered "theft of services" the same way every act of forced robbery from a store can be considered "theft of services". The difference is that the "service" stolen is sex, which is treated completely differently under the law.
It sounds like the equivalent of treating a crime like murder as "violating city code". - TheBrat, on 10/22/2007, -1/+12So by that logic, a bank teller held at gunpoint handing over money from a till would be less "devasted" than a housewife mugged in an alley at gunpoint because the bank teller is used to handing over money?
- SirZRX, on 10/29/2007, -1/+12maybe he is that ugly LOL
- faskill, on 10/22/2007, -5/+16Does she have a right to refuse once she's taken the money then? Think about that for a few.
- 89vision, on 10/23/2007, -13/+23Damn shoplifters...
- empraptor, on 10/22/2007, -0/+10The agreement to exchange sex for money was broken once the gun came to play. The agreement was breached at that point because it was clear the men did not intend to fulfill their end. She didn't provide a service at gunpoint. She was raped at gunpoint.
- J-0-E, on 10/21/2007, -4/+14I can see the judge's reasoning, so why not multiple charges? Seems the perps should be charged with BOTH.
- jmgb, on 10/22/2007, -1/+11prostitution shouldn't even come into this. it's irrelevant. a prostitute does not consent unless she is paid, which didn't happen here. there is no client/prostitute relationship. so to say that she consented just because she is a prostitute is ridiculous. being a prostitute does not means you discard your right to decide when to have sex. this ruling basically makes it open season on raping prostitutes, which apparently, is what the judge wants. disgraceful.
i'm not saying that prostitution is the greatest of life choices, but women deserve better than this. - Modizzle, on 10/22/2007, -3/+13Right. Robbery is taking something that is offered without paying for it. She never offered non-conestual sex. Taking non-consentual sex should always be rape. That way, even if the rapist paid for it afterward, it still would have been a case of rape.
- amarillista, on 10/21/2007, -2/+11Okay, rape of a prostitute is very difficult to prosecute. They are going to bring up every bit of her sexual and criminal history in court to discredit her claim of not consenting, plus it could be argued that she consented when they picked her up.
Armed robbery however carries sentences sentences of about the same amount as sexual assault, is easier to prosecute, and under the circumstances will likely bring no sympathy from a jury (as most people see this as rape at gunpoint anyways). Good news federal gun charges, bad news no sex offender registry for these losers. - noumuon, on 10/22/2007, -0/+9how exactly does one offer non-consensual sex?
- tehbored, on 10/21/2007, -0/+9I suppose if it was just him and not also his friends the charge would have been applicable. It would have been just like if they had sex but he didn't pay her afterwards; it would have been theft. In this case, it would have been theft at gunpoint, but still theft. The fact that he brought in friends to join changes the situation a bit, since she didn't consent to that.
- Carburetor, on 10/22/2007, -2/+10Dude, I'm not justifying the oldest occupation in the world,
but, I don't think the average hooker woke up one day and said
"I want to be a hooker!".
Not all of them are junkies.
I read about it once, where a hooker were interviewed and said she's doing it in order to be able to feed her kids.
Other hooker said she needs to earn some funds in order to finance her first degree.
They're people, sad, miserable, humiliated, but still, people. - xtc46, on 10/22/2007, -1/+9thats a parenting tip ass.
