And now that he has, they went in, reviewed the tapes and material and such, and deemed it all "offensive" so he's been arrested. It's ridiculous. Most of the town disagrees with this. I mean, we understand, a porn store is bound to have porn in it. The debate has been raging over how the store will destroy families and increase crime. It's crazy. I'm embarrassed to live here. 1. The town will have no porn shops. Let's face it, as disgusting as these types of prosecutions are, porn "book stores" are so outdated and for the most part useless for anything beyond a place for senators to cross-dress and meet for anonymous gay sex as a precursor for writing more anti-obscenity laws. Hint for porn fans in Staunton: Get DSL.
2. The prosecutor will lose and lose his job. But the local cops who got behind all this usually don't let up after things like this. The book store owners will need to identify which cops are the zealots and get restraining orders against them in order to stay in business. Good luck to them if they have an incident requiring the police. (which never, ever happens at these places of course) And yes, strip bar owners, porn shop owners, strippers, etc CAN (and have) get restraining orders against individual cops. There is such a thing as a vendetta, and harassment. Turns out that's not what we pay them for, hanging around strip bars all night while home invasions are happening.
My biggest problem with all this is that someone is being prevented from running a legal business by a bunch of local zealots. Let's decide if it's a legal business or not and go from there. But stuff like this is just harassment. I'm particularly disgusted by the frequency of churches in the poor areas of my town, interspersed with liquor stores and porn shops. Sin, forgive, sin,forgive,sin, etc etc. I personally think the churches are taking advantage just as much as the others, and are cashing in. But guess what? They're legal. All of them. But keep in mind that people might not go to war with you over porn, eventually they WILL get fed up with you using religion to chip away at our laws, rights and freedoms. What if they come for your churches someday? Will you go crying to the ACLU, or will they come to you without you even asking for help? Seriously though, this happens because the only way pornography is allowed is if it can be protected under the free speech rights for artistic expression. And since thats kinda an objective point, it usually comes down to directives that originate from the attorney general, which is influenced by the policy of the administration in office. I remember this being discussed a few months back because Bush along with Gonzales , as part of the whole party-of-family-values-while-*****-in-airport-bathrooms schtick, wanted to start pushing cases of pornography being indecent in any form. Im not saying that there arent laws on the books for this kind of thing, but pornography is sort of a grey area in terms of the law, and so you can see huge swings based on whos in power in terms of whether they want to leave it alone or if they want to push it as a hot button issue.
