- BionicPimp, on 02/27/2009, -3/+9I don't know about every state, but in CA, if there isn't a crosswalk in 100ft ( that's not really far ) you can legally cross without it being jaywalking. my 2cents...it's classic cop CYA behavior. To bust the driver, you have to 'bust' the jaywalker so that in court, the driver can't bring up the jaywalker as a defense (although running over someones grandma is pretty much indefensible).

It's not just unjust, it's stupid. You say "the law is the law?" You know what? The law is often an ass, and the police should have enough discernment to understand that they need to promote the outcome, an orderly society, not just mindlessly enforce the law. When you punish people for technicalities, you make them think that the system is more concerned with numbers (and too often it actually is!!) than the goal it was created to serve.

I'm not a lawyer, and this certainly seems a little harsh, but it may be to keep the driver from having a legal "out" by doing everything exactly "by the book" so to speak.

The only other thing I can think of is if the bus driver drove up to a place where he could turn around so he could drop them off on the other side of the street.

Regardless of whether anyone else broke the law jaywalking it does not mean you can INTENTIONALLY hit them and "its ok" because they broke the law first.
