There might be a tiny danger of personal liability from leaving a connection open, but the possible good outweighs it. And the idea that something broadcast through someone's body is off limits by assumption is just asinine at best.

How is one supposed to determine which networks are being willingly given away and which ones are just unsecured? My personal favorite providers are "linksys" and "netgear". The point being, if you don't want people using your wi-fi, take time to learn how to secure it.

Or, to make the comparison to public router settings more accurate, does your home broadcast that welcome message to anyone and everyone close enough to hear it? If so, I think you're going to have a tough time prosecuting a trespassing charge.
As Dawnrazor pointed out, you can successfully prosecute someone for using your public wireless router today, but I think that will change as technology-ignorant judges get old and get replaced. There is no significant moral difference between a public router and a public webserver - don't use either one so much that you qualify as a denial-of-service attack, but to think you have to manually get someone's permission before making a WiFi connection is as ludicrous as getting permission before making an HTTP connection. Being able to automatically allow or deny people access is one of the things we design computer systems to do! We're not talking about buffer overflows and exploited bugs here - if you're using a computer that is configured to authorize anyone else to access it, you haven't been "hacked" when someone else decides to.

If you don't know whether someone has their connection opened up for free use, ask them first. It's common courtesy. Otherwise, you're taking advantage of their forgetfulness, or more commonly, their lack of knowledge.
