Judge sleeps through trial; not enough to overturn conviction

smh.com.au — Two men convicted by a judge who was accused of sleeping during their drug trial have failed to get their convictions overturned. Even though their were periods when the judge was actually snoring, the appeals court concluded that "no relevant distinction is to be made between a judge who is asleep and one who is awake but inattentive".

  • openthink, on 10/10/2007, -0/+2the appeals ct ruling is hilariously absurd. by their analysis, why bother even having judges present during a trial since, it appears, there's no need to establish that the judge was even conscious of the proceedings. of course, many trials might be better without a judge at all...so maybe this is a new progressive form of justice-making. in fact, why bother with appeals courts -- those 3 judges ought to be laid off as well.
