"© digg Inc. 2006"
This means that nobody can use the digg trademark without permission. Whoever made DiggGames should have asked first.
Digg is legally obligated to protect its trademark. This has nothing to do with big business or small business practices. DiggGames.com is using digg, a trademarked name, without permission. Plain and simple. This is like launching a website called "GoogleGames" or "DisneyGames" or whatever. The point is, such a name misrepresents the actual company, in this case Google and Disney respectively. Therefore it is in digg's best interests to make DiggGames change its name.
And there is no reason to get worked up over a Cease and Decist letter. C&D letters are merely warnings, not subpoenas; they state the problem and warn about the consequences of persisting with the action in question. This doesn't mean that digg is sueing DiggGames. Wouldn't that still be protecting their name and it wouldn't piss off anybody?

digggames could cause similar confusion. - Rasdan, on 10/12/2007, -1/+2They have no choice. They must defend their trademarks. It is very easy for digggames.com to be confused with a possible feature dedicated just to gaming, similar to how Tech Crunch has offshoots like Mobile Crunch.
I doubt Digg really wanted to pursue this but they have to defend their trademarks. It's like when MS threatened to sue Mike Rowe for his URL for mikerowesoft.com - he made software so there was possible confusion. Cold, empty C&D letters are a great way to piss off those that helped build the company.
