- geodebug, on 05/13/2009, -0/+22Well, there was that episode of "The Wire" where they fooled a gang-banger by "scanning" his hand on the photocopier and telling him it was a lie detector.
I guess this is the reason you shut up until a lawyer is present. - Oea420, on 05/13/2009, -0/+10Uhh, why would you accept to take the test?
Just sit there silent, don't say *****.
Honestly, the best thing you can do in any situation with the law is just keep your mouth shut. Do as they ask, but just don't say anything that you don't need to.
Don't allow searches, don't allow entry into your vehicle, make it clear you know your rights. - spritom, on 05/13/2009, -0/+10Fully legal. Law enforcement is allowed to lie in an investigation. However the suspect can get in big trouble if they lie (even if they are innocent of anything regarding the original investigation).
Saying nothing cannot be used against you.
Anything said, can be used against you.
Anything said, cannot be used for you.
Video - "Don't Talk to the Police" (part 1-lawyer=27min...part 2-cop=21min)
http://video.google.com/videosearch?hl=en&ie=U ... - allocate, on 05/13/2009, -0/+6Cops can definitely legally lie to you, so why would this be any different?
- DrDash, on 05/13/2009, -2/+8If I was innocent this "trick" or any of the others simply would not work. Seems to me these tricks would really only work on the guilty. I am not going to confess to something I did not do, even if I am scanned by the photocopier. I am assuming I am innocent and will talk to the police everyone above seems to assume they are guilty.
- BruisedGhost, on 05/13/2009, -0/+5it worked in the Wire
- shadus, on 05/14/2009, -0/+5Regardless of if this is or isn't legal, it shouldn't be. The correct answer is always decline to talk to the police unless they're going to charge you with something and if they charge you with something say nothing except to your attorney. You can only incriminate yourself talking to the police if you're innocent. You can only convict yourself talking to the police if you're guilty.
- emailowndme, on 05/14/2009, -0/+4anything you say after your miranda rights can be recorded, or recited by memory by a police officer.
This is why you have the right to remain silent, because otherwise you have a police officer trying to remember exactly where you said you were, and if he's wrong, it's your word versus his.
Your regular word, versus his serve and protect, helper of the people, super special infallible word.
This is why you never talk to police officers. - poprocksandsoda, on 05/14/2009, -1/+5There is nothing illegal about this at all. Innocent or guilty, if you are getting questioned by the police never say anything. Take the 5th no matter what. Watch this video, it's the most important video you can ever see:
http://video.google.com/videoplay?docid=8167533318 ... - enevitable, on 05/13/2009, -0/+3Yeah this trick wouldn't work on me either. However there are countless tales of innocent people who have been bullied by the police into admitting something they haven't done.
***** even if I was guilty of a crime I wouldn't change my story for anything. - PhilliesBlunt, on 05/14/2009, -0/+3Bunk Moreland ftw!!
- cptshamrock, on 05/14/2009, -0/+2First thing I thought of when I read that headline.
OMAR COMIN'! - JamesWjRose, on 05/13/2009, -2/+4Good post.
Yes, police can lie. I find that sad, pathetic and wrong. But they can. They SHOULD not be allowed to... but that's another conversation.
Again, to echo Spirtom. Do NOT speak with the police. EVER. Yes, I know "ever" is a strong word. But really, stfu. It's in your own best interest. - AnotherDiggGuy, on 05/14/2009, -0/+2It's people like you that give the police a bad name.
The best thing to do is to tell the truth.
If the truth is you did something bad, well ***** you, you deserve to go through the courts and accept your punishments.
Let me guess. You think most people in prison were falsely placed there. That the police tampered with evidence to make you appear guilty. - imacommi, on 05/14/2009, -0/+1***** THE POLICE!... yeah I said it!
- Ajajadude, on 05/14/2009, -0/+1If you're innocent, then why would it matter if they lied to trick you into confessing? If they could use that fake test as evidence, then I'd be worried.
But, you're right, keep your mouth shut, especially if you have a reason to do so. - Ajajadude, on 05/14/2009, -0/+1Bullying and tricking are two different things, at least to me. There are laws against forcing confessions out of people under duress (of course, when does a little law stop some people?).
- Haoie, on 05/13/2009, -1/+2Classic urban legend: Police fool suspect into thinking he's undergoing a lie test with a colander connected with wires on his head.
- Nattybumpoe, on 05/14/2009, -0/+1I agree with JamesWjRose, but there are certain circumstances where they can use silence against you (I believe it is pre-Maranda silence (the Court hasn't ruled on it)).
- zuiquan, on 05/19/2009, -0/+1Never, ever, ever talk to the police. Even, or perhaps especially, if you're completely innocent. Ask for representation. Don't get boned.
- AnotherDiggGuy, on 05/14/2009, -0/+1Why wouldn't it be legal?
Is this one of those things the liberals are going to redefine as torture? Cruel and inhumane?
Maybe one day we won't even be legally able to take criminals into custody. - Narkinbarf, on 05/14/2009, -0/+1All lie detector tests are fake.
- kplo, on 05/14/2009, -0/+1When you walk through the garden....
- guestaccount, on 05/14/2009, -0/+1Yes, its legal. If you are in the presence of police, its best you just shut up entirely.
- mattnyc99, on 05/14/2009, -0/+1sadly, i guess it is legal. oh, justice....
- levitron, on 05/14/2009, -1/+1Wasn't a similar situation shown on the first season of CSI: NY? Not that I'm trying to accuse those shows of accuracy, by any stretch...
- AnotherDiggGuy, on 05/14/2009, -1/+1You do realize most police don't lie, right?
The lack of respect for the police shocks me. The police will come to your house and take out your potential killer within moments. I'm willing to bet most your friends probably wouldn't even do that for you.
Just because you saw a video of a bad cop beating a suspect for unjust reasons, you can't assume the other 20,000 arrests in the US that day ended up the same. - noahhoward, on 05/13/2009, -3/+2Who cares? Of all the things to be pissed about we're going to pick the fact that they trick people who have commited crimes into believing they've been caught?
If you're innocent, you're not going to be caught by this. Someone pointed out above that police have bullied innocent people into confessions, THAT is illegal and if they're bullying they should be stopped. But faking a lie detector is not bullying. - desotohawk, on 05/13/2009, -7/+6The police are nothing more than professional liars.
- oldhick, on 05/14/2009, -5/+1Buried as lame.
