I don't understand if you are trying to be funny or not... How does one hate their neighbors by not liking what they are doing -WITH- their yard, but then stand up for what someone is doing -IN- their yard??? These are both "public" events, no?
Really all the judge said was, "prosecutors had failed to prove that Mrozek's back yard was a 'public place' where the couple should have expected to be seen." This is not a defense if someone was committing other crimes... like contructing explosive devices or something... but those activities are usually illegal in and of themeselves whether they are public or not.
I myself believe that someone's yard is usually a public place because one can be seen from the outside. Numerous other examples defend this... such as police fly overs.
