- otatop, on 10/22/2007, -11/+221The bill goes against Article 1, Section 9 of the Constitution.
http://www.usconstitution.net/xconst_A1Sec9.html - hiphoc, on 10/22/2007, -11/+208Very true, retroactive laws are unconstitutional. But so is torture, undeclared wars, no speech zones, stolen elections, the Federal Reserve, direct unapportioned tax on labor just to name a few. Who is gonna stop the Congress from passing more illegal laws? 99% of what the government does is illegal when you look at the constitution. By the way, the president and the phone companies say they have not been doing anything illegal. If so, why do they need retroactive immunity?
Government basically works like this: Baby, let me put the tip in, just the tip OK? Then 9 months later we all end up with new expenses and no support. - MaximusIGN, on 10/20/2007, -21/+182More proof that Bush believes that laws are only for the little people...
- UtopiaInTheSky, on 10/21/2007, -4/+139Are people actually calling his office? Seriously, let's Digg effect this guy's phone line.
- quaxon, on 10/22/2007, -0/+76"Umm hi, I'm interested in over-throwing the government, and am just a bit confused as to where to sign to get that retroactive immunity ive heard so much about?"
- brainScan, on 10/20/2007, -2/+77Sadly it's not just Bush... it's rampant through our government.

- rabidmonkey1, on 10/31/2007, -3/+69"No Bill of Attainder or ex post facto Law shall be passed."

- HanSolo69, on 10/20/2007, -1/+36Jay Rockefeller's voice mail is officially experiencing the Digg Effect. Here is the recorded proof:
http://www.youtube.com/watch?v=XL1Xg_GMoj0 - ISurfTooMuch, on 10/20/2007, -0/+35Sen. Chris Dodd has said he intends to place a hold on the bill. This is a tool that can be used by a Senator to keep a bill from passing.
Read about it here, then contact him to offer your support.
http://digg.com/tech_news/Senator_Dodd_Announces_H ... - militant, on 10/20/2007, -0/+33i did call, at 4:20 this afternoon, on my way to the athens ohio ron paul meetup group. i'm from west virginia, he's my senator. so i sez 'hi this is bob in parkersburg, i'm wondering if this is the line i call for retroactive immunity for past felony acts?' and he says 'UHHH no! but you can give us your email address and we'll send you the press release' ... my response: 'i think the NSA probably has it already, go ask them. ***** rockefeller. *click*' ... i felt like a badass. had to have a camel after that.
- crapmatic, on 10/20/2007, -0/+32I am goddamn SICK of all these Congressmen who are nothing more than industry shills. I can't wait until elections... even if it's pointless, it's going to feel therapeutic to vote them all out. I'm thinking of making a few bumper stickers. My Congressmen are of course all bought and paid for.... it pisses me off to no end that I have a government directed by boardrooms and attorneys.
- DigeratiPrime, on 10/21/2007, -0/+27When the people fear their government, there is tyranny; when the government fears the people, there is liberty.
Thomas Jefferson - gdog05, on 10/19/2007, -1/+27I found out that my VoIP service (Lingo) allows you to forward any incoming number to any outgoing number. Anybody have VoIP and a horrible bill collector or something that wants to send them to the esteemed senator's office?
- mathmanjeffy, on 10/20/2007, -4/+28Our history is rife with incidents of presidents overstepping their bounds and giving themselves more power; Bush was hardly the trend setter here.
- jmpeagle, on 10/22/2007, -0/+24the fullest extent of the current law allows them to get off free of charge, that's the problem
- jmpeagle, on 10/21/2007, -0/+23the way our system is set up is that only the Courts can decide on the constitutionality of a law. The people cannot.
- reeder, on 10/19/2007, -5/+28Your argument smells funny. Either that or I need to clean my shoes.
No, it's you argument. - sevenoutdb, on 10/20/2007, -0/+22I just called and asked for retroactive immunity for Jaywalking.
- wilsonics, on 10/20/2007, -0/+21I left my phone number and said the quote then added "even though i don't do any illegal acts, i would like to protect myself in case i do accidentally do one in the future, just like the phone companies can. Please change your bill."
- Ductapemaster, on 10/22/2007, -1/+21I doubt that Bush has actually read the Constitution
- mreed, on 10/20/2007, -4/+23Unfortunately, it doesn't. From your own link:
In U.S. Constitutional Law, the definition of what is ex post facto is more limited. The first definition of what exactly constitutes an ex post facto law is found in Calder v Bull (3 US 386 [1798]), in the opinion of Justice Chase:
1st. Every law that makes an action done before the passing of the law, and which was innocent when done, criminal; and punishes such action. 2d. Every law that aggravates a crime, or makes it greater than it was, when committed. 3d. Every law that changes the punishment, and inflicts a greater punishment, than the law annexed to the crime, when committed. 4th. Every law that alters the legal rules of evidence, and receives less, or different, testimony, than the law required at the time of the commission of the offense, in order to convict the offender.
In other words, it's only unconstitutional if the law makes something that was legal at the time it was done a crime, retroactively. Making something that *was* a crime *legal* is fine. - Neiby, on 10/20/2007, -3/+21I agree and disagree with you. The Executive branch currently has *far* more power than the Constitution allows. That hasn't stopped them from continually asserting new powers they were never granted.
The NSA most certainly has been spying on American citizens for many years. - scuzzman, on 10/20/2007, -2/+20But this applies only to laws that make the punishment worse, or that alter the evidence. Really, I don't think he's violating the Constution. I don't agree with it, but it's not illegal as far as the Constitution is concerned.
From that site:

That is the first opinion. I'm not sure of any cases that have been tried since, though I haven't researched the topic. - LastVisibleDog, on 10/22/2007, -7/+24Senator Jay Rockefeller is a Democrat (don't be such a blind partisan dweeb)
- CatManDoIt, on 10/20/2007, -1/+18Calling a senator to complain is not illegal.
- ImperatorTerrae, on 10/24/2007, -1/+18"Hi, this is Osama Bin Laden, I was wondering if I could get some retroactive immunity for that hijacking thing. Oh, it has to be legal now to be retroactive? Oh that's ok, I'll just wait until George Bush makes hijacking legal. It's bound to be soon right? What do you think, three weeks? OK, I'll call back then."

Some even believe we are part of a secret
cabal working against the best interests
of the United States, characterizing my
family and me as "internationalists" and
of conspiring with others around the world
to build a more integrated global political
and economic structure - ONE WORLD, if you will
. IF THAT'S THE CHARGE, I STAND GUILTY, AND I AM PROUD OF IT.

- jmpeagle, on 10/20/2007, -5/+18they are only for the little people. Name one society where the rich and powerful are held to the same standards as a regular street criminal. It will always be this way and has always been this way since by definition it is the ones in power/powerful who make the laws and determine what is legal.
- doctorfungi, on 10/20/2007, -0/+12Who is your daddy, and what does he do?

- N3M3515, on 10/19/2007, -0/+11What we should really do is goto his cross box (local telco phone distribution box) find his binding posts and plug a but set into his phone and wire tap him, and see how he likes it.
- camfulton, on 10/19/2007, -0/+11I called, you just get the offices answering service. However, I suppose we could flood his voicemail...
- phunlee, on 10/19/2007, -4/+14He's never said he plans to shut the IRS down the day he's elected. Eliminating the IRS is a result of reducing federal spending and eliminating the need for an income tax that hinders so many and steals so much. I'm a Democratic voter, but I believe in the Constitution more than I believe in any political party. I'm just glad this guy's read the damn thing.

- sockpuppets, on 10/19/2007, -9/+18Radioactive immunity! Cool, now sockpuppets is a superhero.
- brainScan, on 10/19/2007, -3/+12There wasn't even an argument there!!! Just a bunch of name calling. When you don't have a leg of logic to stand on, just call your opponent names. Oh, and the hate card always rallies the troops as well.
- vinwal, on 10/26/2007, -1/+10You pathetic scared little sheep, the CIA's actions have done nothing but fostered and funded terrorists.
