If all potential criminals knew they would be whipped in public until they were sobbing for mercy... The punishment should fit the crime. I think all violent offenders should have something like this, with only the lashing for minor offenses rather than jail time. How many violent people would ignore a restraining order or control their tempers if they knew they would get a mandatory lashing? I was seriously outraged by that caning of an American in Singapore years ago, but I believe I have changed my mind on the subject.

The reason it was used for punishment wasn't just because it hurt like hell and deterred the person from commiting it again. It was because the guys that lived would be walking around on the boat without a shirt. I also remember old folks and parents threatening the 'cat' to deter children from misbehaving while I was growing up. It sounds unusual, but in this case the punishment fits the crime.

Personally, I don't really find this to fall under the heading cruel and unusual punishment. When that line was put into the constitution, there were some pretty messed up things that used to happen to people, the most notable perhaps was being drawn and quartered. State in lucid language your reasons for condemning corporal punishment and you might see some actual debate in response. Let's say someone rapes and kills your Mom, are you going to be satisfied that he is now living in a facility tucked away from society, watching tv, eating 3 square meals a day and working out? No, you are going to hope he gets ass raped and killed in prison.
If our prisons were actually what we intend them to be, then there would be no raping/killing in prison and it wouldn't be that bad of a place. It's the corporal punishment unintentionally built into the system that gives victims their retribution.
In the end, what's a few lashes. Yeah, it hurts the criminal, but it reinforces our public condemnation of the crime. Criminals should be placed in cages in public places so that they can be spit on and ridiculed. There should be no honor in being a thief. There should be no "street cred" for killing another human being. You should be showcased as the lowlife that you are. This would reinforce our societal values to everyone by putting criminals in their proper place in the heirarchy, as human spitoons.
If you think this wouldn't be a deterrent, then you don't understand human nature. There was a reason that execution used to be public. People respond to communal condemnation. - Corvidae, on 10/12/2007, -0/+4The point of brutal physical punishments is not to stop the person you are hurting. It's not going to work, and may very well make the person a more hardened criminal. Either way he's gonna need some mental work before he's safe to let out in public again. If your going to have to rebuild someone's mind anyway, you may as well make use of him before then, and get a jump start on breaking them down in the first place.
The people it does work on are the innocent bystanders that haven't commited a crime yet. The key point being 'yet'. Regimes throughout history have shown that public punishment of crimes does work as long as your laws are just and fair. The downside is that you'll have order right up to the point you have outright revolt if the laws are abused (It's almost garunteed to happen at some point)
While it may be a barbaric punishment, it can also be an effective one for keeping the public safe. The real issue is that of any government, at some point it will be abused. You should consider the fact that many people agree with this method of punishment a reason as to why it's NOT "sick". Saying something is "sick" or "cruel" is relative to what we define is humane. Everyone else seems to think of it fine.
How can it not work? The idea is not just the lashings but the fact that they would be made in public for everyone to see. "If you do this, this happens to you." I find it logical, if anything. I just think someone was beaten too much as a kid. Corporal punishment works, especially when coupled with vigilant enforcement.
