He simply plead guilty and that was the agreement in order to reduce his sentence from 20 to 1 years. How is it we have boys elsewhere in the country dealing with far worse sentences for consensual sex with a girl a few years younger when this, lenient sentencing, is possible in our court system? Can judges be that stupid, in this case, yet otherwise be so harsh, in those teen's cases, by not to giving lenient sentencing?

If i were the father of that little girl, i would be happy with that sentence for obvious reasons. The perpetrator though would wish to god he had received a much longer sentence.

4) congratulations, he was also credited for time he's spent in jail, meaning he will be released in three months.

They said the girl flipped out when she saw him in court...wouldn't she not have to see him if she testified via closed circuit tv? If that is true, I'm not seeing the prosecutor taking a plea deal. Then again, I'm not lawman.

It is NOT just rape, it was against a child meaning this is the very worst of predators and will do the same crimes again if allowed in the future which the children may not be as lucky as many repeat offenders eventually murder the child to attempt to cover up the crime. - benicillin1, on 06/14/2009, -0/+5yeah underage are allowed to testify via closed circuit if the judge feels its appropriate to protect them from harm. its kind of a high standard though, you have to really prove that there is some serious harm that will occur to the kid if they are in court. it sort of skirts the provision of the constitution that one must be able to face their accused (the confrontation clause), thus the need for the high standard. i would think it wouldn't be a problem here, however, as the kid is really young and its a sexual abuse case (the typical situation in which closed circuit is allowed) - more on the conf. clause here http://www.libraryindex.com/pages/1419/Child-Abuse ...
Seems like a very odd situation though, especially since the brother had a potential claim that was dropped. I'm guessing they weren't gonna be able to qualify the kid as a competent witness and his own testimony would have been the only thing bolstering that particular claim. Same issue with the girl - have to ask a minor questions on the stand to prove they are competent and know the difference between right and wrong. Without establishing this, you don't have much to work with.
Now we all know the truth because he admitted it in the plea deal, but had he not entered into this agmt im sure the guy would have pled not guilty and it would have been his word against that of a 5 year old. life presents us with tough situations, but there's not really much else they could do here absent some evidence other than the kids' testimonies. Having said that, it's still a terrible outcome. Someone in the prosecutor's office needs to go to a negotiating class. - GeekNurse, on 06/14/2009, -1/+5Wow dude... - flipdoubt, on 06/14/2009, -0/+3But Federal Mandatory Minimums put non-violent "drug" offenders away for decades or lifetimes, while rapists & armed robbers go through the "turn-style" justice system... anyone else see a problem here? Also, many of the above mentioned "drug" offenders, are being held for possession of substances *far* less dangerous than alcohol, (a legally sanctioned and controlled "drug") - many of which are *naturally occurring* in our ecosystem - these people are being jailed for possession of NATURE.

The mentality you propose works for parents grounding a kid who broke curfew without their knowledge. If he goes and admits it to them, they ground him for three days instead of a month, makes pefect sense.

- beachtrader, on 06/14/2009, -0/+3But the Judge does not have to follow the agreement between the DA and the defense. While, in almost all cases, the Judge does abide by any Plea deal between the two, they ARE NOT REQUIRED to do so. In fact, when pleading guilty or no contest in any deal the defendant is informed in court that the Judge does not have to abide by any plea agreement and could face a harsher sentence then the one agreed to by the DA and the defense. Therefore, its the Judge who deserves blame in the situation, not the DA or anyone else because the Judge could have easily said this crime is abhorrent to the normal social behavior people should exhibit I am imposing a maximum sentence.

Why wasn't he locked up if the law is all about persecuting gays? If he had been having young girls over then I bet the story would have been different. BTW, he and i did not see eye to eye on the age of his partners and after 7 months he went elsewhere to live. I am amazed you couldn't find some way to bring race into it also. There is always one in the group. Oh, and just for the record, if you do the crime then expect the time. If some people get longer sentences than others, as bad as that is, if they weren't doing the criminal act then they wouldn't be getting the time. You can give a million years for rape or murder or stealing and it won;t bother me because I don't do that stuff. OK, maybe I am on a rant and didn't realize it. Just go away.
