The INS doesn't start proceedings against illegals who commit crimes, they just deport them or send them to jail. They start proceedings against legal immigrants to revoke their status. So the guy was probably legal. This case has nothing to do with weak immigration laws, it has everything to do with the guys' 17 other "violations." Were they for speeding? Parking tickets? We don't know.
Because the guy is from Ecuador, the submitter came up with the most damaging possible interpretation of the facts and then threw in a bunch of absolute b.s. on top. He isn't here to share facts, he's here to push an agenda. Most of us are immigrants here in North America. What the hell difference does it make where someone's from when they do something like this?! They should be punished equally, and the punishment should be much worse than 5 years in prison. As far as I'm concerned this should be considered a deliberate act of harm to another individual. It reminds me of a guy who lived in my building during college. He had about as many DUI convictions. He eventually had his license taken away for a year. Two days after he got it back he totaled his car drunk driving. It was a good thing. Nobody was hurt and he was such a ***** up there was no way he could get his hands on another car so he was neutralized as a threat to others.

My point here is that you think this news is outrageous ONLY because it was committed by illegal aliens. Focusing only on the trespasses of illegal aliens in order to "prove" that they are a bunch of "animals" who "celebrate drinking and driving" is pure racism. MOST of these people are honest, hard working women and men who are only asking to be given a chance to live normal lives. I am all for prosecuting drunk drivers, rapists, child molesters, murderers, wife-beaters, and other scum of this world. I just don't think that the color of people's skin and their legal status in this country makes them more or less bad than those who are white and citizens.
I feel very bad for this girl, it is such a tragedy that her life will be bound to wheelchairs and hospitals. My heart goes to her and her family. That's such a profound loss for all of them. What I still don't understand though is how would she be better off if the guy who hurt her were white and had proper documents?
Obviously, hating and scapegoating illegal immigrants is your way of coping with this country's crappy economy, war that's costing us not only BILLIONS of dollars but THOUSANDS OF LIVES, poor health care and criminal social policy. this guy should have been deported a very long time ago. he is not guilty of a causing an injury due via DUI *because* he entered into this country illegally, he is guilty of a DUI because he made a very bad choice and our laws provide a very harsh ramification for that: prison. Send him back home? Of course... but, the reason U.S. immigration policy puts deportable aliens in our jails first before deportation is to make sure that if people do come here illegally they are quite aware they won't get off the hook by the U.S. simply deporting them (and probably coming back). Save money or ensure people know if they do wrong they go to prison, not a "exit card" out of the U.S. This has been debated since the dawn of immigration law. It's policy/law for a reason.
crimes are committed by the people who commit them, not because of their status. enough with this ***** xenophobia. I.C.E. should have gotten rid of this guy a very long time ago. This guy deserves punishment under law and ICE needs the tools it needs to do what is legally mandated of it to do.

The only source that substantiates anything about his immigration status is a wildly biased anti-immigration site, while the article submitted says absolutely nothing about him being illegal. In fact, a google news search reveals no objective websites commenting on Carcamo's immigration status. The only sites that mention it are other xenophobic anti-immigration sites that simply parrot each other.

This state of affairs is exactly the same in the UK, we have repeat offenders doing the same thing over and over again, going to jail, coming out and offending again. It needs to stop.
I don't know what to suggest, but a 3 strikes and you're out would be a start. And why the hell do prisoners not have to work from 9-5 every day to pay for their rent & food just like the rest of us, extra cash could be spent on luxuries, for example a television or radio. This would mean that after a period in jail, they are not conditioned to sitting around (pumping iron/taking drugs/learning to be a better criminal/pumping ass), but used to grafting every day and taking responsibility for their lives. Upon release, they may find it easier to 'slot' back into society.
I don't know the answer, but something needs to change.

VERY FRUSTRATING, and sad. - Swift2, on 10/12/2007, -0/+6There are two sides to this issue: one is, declare the U.S. a flat and free space, to which anyone can come. This has been the labor policy of the United States since the mid-70s, most strongly, but not only, by free-trade conservatives. They decided to bust unions, because, well, don't ask a right-winger why, God makes him attack unions. Now, under the past system, Swift meatpackers in the midwest were paid more than $20 an hour for dangerous, hard work. And the truth is, any illegal applying for this job then for $7.00 an hour would have been kept away by the same labor laws which gave people the right to organize.
Now, when Swift paid $20 an hour, the community gained a lot of revenue with that, to build schools and roads and such. And the workers, doing one of the most dangerous jobs in North America -- no kidding -- could buy a home and send their kids to college if they wanted. And they had health and retirement benefits.
Now, when you basically abolish the Labor Department, and change the regulations so that the process of union ratification takes forever, and impose no penalties on business for dropping the worker's pay by 2/3, dropping the medical insurance and so on, and having a free hand on working conditions, then you create a world where labor competition has full rein. Mexicans work cheap.
They used to cross the border every year for the seasonal jobs like crops and such. When the harvest was done, they left. When our new conservative masters designed the present labor system, a huge increase in low-cost labor was inevitable. In fact, it was desired.
The raid on the meatpackers this week, with the usual lying photo-ops from the Bush administration, was simply turning over one stone in a situation that has been going on for years. I read exposes about these meatpackers back in the '90s. The fact is, plant management makes contracts with coyotes to go get workers on one side of the border or another. They recruit massively, because, after all, nobody's going to find their way to a meatpacker in Kansas from the Rio Grande. and with minimum-wage workers, you're always finding more because they don't last.
One of the places they go, of course, is the local emergency ward, thus costing taxpayers instead of their non-existent medical coverage.
So I agree that something has to come after "free trade," because this country didn't grow because of trade, but because of the high tariffs that made internal development possible. But it's ironic that the same parties who defined the neoliberal era of free trade are now desperately trying to make us blame the whole thing on this racist idea of the "invading hordes." The government made the vacuum. Informal immigration is filling it, as the free-traders desired.
One of the problems with the free trade doctrine is that it's about as secure as Windows XP before SP2. At the moment its called 'Careless Driving' (which carries a fine/supervision order) but will be upgraded to 'Dangerous Driving'. This will mean that a manslaughter charge can be brought in the event of a death and (potentially) a custodial life sentence whether someone dies or not.
