I'm going to say something I'm going to get buried for... Did this man really deserve the outcome of the patents? He didn't actually construct a working prototype. He could have never sold it commercially. I'm honestly tired of these patent battles. They stem innovation. Right now every company from Rim to Apple are having patent litigations. I'm a liberal by the way. More often these patent battles hurt the little guy. Why is it that our soy farmers can't buy organic soy beans? These patent battles are stupid. You can't patent a f**king idea or method.

Let me rephrase that, you shouldn't be able to get a patent for an idea. Look at Apple, they patented multi-touch, now they're suing every handset maker for using it in their products.

You have just demonstrated how little you know about the patent system. Good job. FYI, you don't need a working prototype to get a patent unless the USPTO denies your application and you want redress. Also, trying to lump in mechanical/electrical designs with biological and software patents DOES NOT COMPUTE, DOES NOT COMPUTE, DOES NOT COMPUTE .....
