many reasons. you have to make sure the party you are suing is fully committed and invested in the product so that they have to deal with you instead of just scrapping the thing. you need to ensure the revenue being made is enough to fund your demands. you hope to catch the company you sue at the point where it makes more sense for them to pay you off than to fight your BS lawsuit in court.. etc.

It can't.
"Code" can be copyrighted but not patented. What can be patented is any new, unique process --- which may or may not be implemented in computer code.
Example: Theoretically, I could obtain a patent on a new form of data compression. Using the information readily available from the patent, you could develop your own code to implement it.
Unless you copied my (or someone else's) code, you haven't violated any copyrights. But you have violated my patent ... just by implementing my unique process.
