I wouldn't put it past Apple to do this.
jameslowellNov 5, 2010
I had my doubts, but after this death grip nonsense anything is possible
waltaaronNov 5, 2010
Install Android 2.2 on a 2 year old MyTouch G1 that should have 1.6... I wonder what will happen?
The problem is, Apple users expect more from Apple. I mean, seriously they expect a lot. Usually Apple gives it to them, and when they don't you would think the world is coming to an end.
Had Apple cut off 3G from the update people would say " OMG how could they force us to upgrade to another phone to get the next update?!?" and when they do their absolute best to give them as much of the update as they can people say "ZOMG it doesn't work well enough, its a conspiracy to get me to upgrade".
Seriously how is Apple the villain here? The Apple customers, and people who spend 90% of their day flaming Apple in the comments will bitch either way they play it.
I think the real baddies are the people who sue cause their outdated technology doesn't automagically improve it's hardware specs, and the people who condone that kind of behavior by pointing their fingers at the company (cough cough YOU).

There is NO WAY you can beleive the bulls**t you just wrote. You cannot brick a phone after two years when you made them think they were BUYING it.
waltaaronNov 5, 2010
Are you stupid, or did you just not read the article or even know what you're talking about? Apple didn't 'brick' anything. It just doesn't run as smooth as the phone used to.... because SUPRISE, it is running software that was designed and optimized for new hardware.
Windows 7 doesn't run very smooth on one of my old desktops, should I sue Microsoft for "bricking" my desktop?

Those of us not infected by the Apple virus have said for years that Apple is just as bad, if not worse, then Microsoft but the fanbois have always been screaming and defending this company.
The only way to go for such OS'es is non-proprietary systems, avoiding leaving one company in control and the owners as slaves of the company, having to fork over money to get their paid for property to start working again. (Where are you taxes are theft people now?)
As usual, with no Apple products owned - I really don't care of they brick all customers phones, pads or tampons!
waltaaronNov 6, 2010
Yeah... it is terrible to have to pay money to keep your computer working... like uh, WIndows and Anti-virus softwares/geek squad.
Non-proprietary systems have just as many issues as proprietary ones. Hardware manufactures in the PC market have proved it time and again with their bloatware and terrible hardware.
Plus Microsoft still puts pressure on those manufactures to keep other FREE alternatives out of the market. That doesn't sound like freedom to me. It sounds like the same kind of mischievous behavior everyone scolds apple for.
When you look at the fragmentation of the smartphone market it is pretty apparent that people want options and like different things. Microsoft spends a lot of time and money preventing other alternatives from even taking hold in a small portion of the PC market.
Lastly and most importantly, unlike you I actually read the article and used logic to figure out that the term 'brick' in the title is actually used to refer to the complaints about the lack of snappiness on iOS 4 on the 3G handsets.
No one BRICKED anything, this person is just frivolously suing Apple because she thinks her hardware should magically update itself to work with a software platform that is constantly evolving to work on newer, faster hardware.
I don't understand the hyper Apple crowd, but I certainly don't understand the rabid hatred people like you hold for Apple either. You read an article like this and you just see repeat the same opinions about Apple while completely ignoring a person who is a disgrace to the American judicial system. Sue-happy scumbags like this should burn in hell for destroying American, but all you see is the Evil Apple you hate soo much... who in this case just tried to bring more features to some outdated hardware.Comment is buried, click here to see the rest.

Another moron who doesn't understand what open software means. You can easily make money off open source OS'es like my company does.
Just because the OS is open source doesn't mean everything else has to cost $0. Too bad you haven't noticed that yet, I make six figures off open source so just to reiterate open source does not mean for free as in free beer.
smokezzNov 6, 2010
There is one key difference in your arguement Waltaaron. You can install Windows XP on your desktop again. Apple doesn't ALLOW you to downgrade your phone once you install iOS 4 on your old phone. Once you do, you're stuck with it forever, no matter how bad it runs.
bryanwebsterNov 5, 2010
THey would be sued if they didn't include the 3gs in the update and now sued that they did.
If they really wanted people to buy the iphone 4 instead they would have made the update not available to the 3gs
krazydlNov 5, 2010
Trust me. If they didn't include update for 3g or 3gs, most of them wouldn't even have known that there was an update. And even people who knew wouldn't have updated since update didn't include nothing special for 3g/3gs anyway.
And where is downgrade option without losing the warranty?
I do have 3g and, after the update, I feel like smashing the damn phone to the wall.
As soon as Windows phone comes out, I am gonna see which one I will buy, android or windows.
No more Apple product for me.Comment is buried, click here to see the rest.

Maybe they'll give upgraders a free case...
waltaaronNov 6, 2010

johnnydiggmeNov 5, 2010
Meh, you can't please everyone. I agree with BryanWebster, there would have been just as many complainers if they didn't include the 3G handset in the update.
TomHanks4Nov 5, 2010
you're upgrading your iOS wrong
johnnydiggmeNov 5, 2010
The law firm behind this will likely also have a suit against GM for not allowing older cars to plug-in to the same unit that the Volt will.
agmlauncherNov 5, 2010
FTA: "but it really brings up an interesting question: how long should handset makers support its legacy hardware?"
I think the answer to that is that in this case Apple should NOT have supported legacy hardware by simply not making the update available to older models - which would have avoided this issue altogether.
Users should have the option of reverting to older versions of software if they want. Not having as many features as newer version is not as bad as having what you currently own, work the way it did when you bought it.
Though I suppose one could argue (weakly) that this is no different from any other physical good that no longer works as well on day 700 as it did on day 1. Though in this situation, that would be because Apple's "improvement" was was responsible for that problem, not due to simple wear and tear.

The guy who wrote this is an idiot. He looks like he is 12 years old and if so, he should not talk about adult stuff. Because IF this claim is true and Apple does this on purpose, there is NO WAY they win this case. You can't trick customers into a 2 year lease when you tell them they are buying the phone. The excuse of "Well...A LOT OF PEOPLE replace their phones every two years!" does not mean a f**king thing legally.
They can stop supporting the device with updates. They CANNOT make the phone unusable.
waltaaronNov 6, 2010
Have you used a 3G with iOS4? hardly "unusable" it basically runs like an outdated Android phone with 2.2. Fairly fast, but laggy animations when swiping between pages and inertial scrolling is chopping along with pinch to zoom
If Apple didn't bring iOS4 to the 3G the same people who don't even own iphones that are bitching now would still be bitching. In fact, no matter what Apple does most of the people on Digg will still be bitching. Apple beat them up and took their lunch money, apparentlyComment is buried, click here to see the rest.
alajoeNov 5, 2010
Apple would be in trouble if I were on the jury, I had a 3gs that I bought just because of how well it would bluetooth to my pioneer car stereo. The ios4 broke it. I can still do all the phone features but I can not stream music from the phone.
There should be an easy way to downgrade to the previous OS. I should not have to "Hack" my phone to revert to the software. This is why I think she has a legitimate complaint.
hackeronNov 5, 2010
I agree, I think the best outcome is Apple should let you downgrade with ease, there is no technical reason not to allow this. The reason they don't allow downgrades probably has more to do with the fact you can jailbreak the older versions.
waltaaronNov 6, 2010
if iOS4 broke your 3GS you are doing it wrong... no seriously it should run just fine. Mine certainly does.
That being said, Yes optional downgrade should be availableComment is buried, click here to see the rest.

Suppose it was intentional (which I doubt), I wonder how in the world they prove such...
People could get fed up and move to Android, so it may be hurting Apple too right?
Am I being too reasonable? Maybe, because I watched rally to restore sanity…
jemmaskevinNov 6, 2010
Get a Windows Phone 7 instead.
catpartyproductionsNov 6, 2010
i think people with a phone that is 4 years old should shuttup, stop being such aholes, and just buy a new phone. they're lucky apple supported them for this long
glitch82Nov 8, 2010
I really don't understand what's happening here. I had a 3GS that ran iOS 4 before I got an iPhone 4, and performance wise both phones were seemingly identical. Of course, I wanted FaceTime, 720p video recording, the new display, LED flash and the gyroscope, so I bought an iPhone 4 anyway. But I was seriously considering keeping my 3GS and opting for the next generation iPhone after the 4 just because of how great it ran.
