Except opposing the RIAA, and supporting certain aspects of TPB doesn't mean that you support all elimination of copyright per-se.

TPB is a site that indexes mostly files that the uploader doesn't have the permission of the copyright holder to distribute.
If, as a copyright holder, you emailed them to ask them to remove a torrent, you get a load "hahah f**k u we're untouchable" back.
I find it hard to sympathise with TPB given what they allow their site to be used for.
Sometimes you need to turn down the "piracy is okay, criticism of it is not".

What you have to understand about registered trademarks is that they are not at all like patents. Even if you register a trademark for use, and are granted the official trademark, you only get very limited rights, and it is almost no help in a trademark infringement lawsuit. When such a lawsuit does occur, you can bring claims under the fed Landham Act or state laws regardless of registration, and the Senior User is not the registered user, but the one who used the mark first in commerce in the geographical location claimed (Here, the US). There is absolutely no doubt the TPB is the senior User and that it has used the trademark for commerce (thing ad revenue) for years, there is no way some dude in NY can overcome that.
The only danger to coming here to litigate would be the government here deciding to prosecute TPB for copyright infringement, but if thats the fear, TPB can just sue in some foreign court under the TRIP agreement and bring a international trademark case as well, to a very similar effect, sinve the US is a signatory state.
TL:DR The law says TPB wins because of how trademarks work.

You not only don't understand trademark law, but don't understand what dnlprkns just wrote.
A common misconception with trademark law is that the "owner" of a trademark is the one who registers it first (like a domain name). The reality is that if someone is using a trademark and was using it first (in the same area), your registration (if it goes through to begin with) is invalid.

Actually they *could* challenge because of the beauty/horror that is our (US) legal system. They should, however, lose on the grounds that dnlprkns stated.
Now if the **AA is behind this the result *could* be different given their obvious willingness to through money at the problem. Additionally (IANAL) they *might* be able to convince a judge/jury that as (according to them) what TPB does with the name is "illegal" then they should have no claim to the trademark.
I'm not saying that is how it should work or that they should win on such grounds, just that (as a laymen) I could see that as being a legitimate argument should you buy into their "illegal" claim.
