I am incredibly informed about marijuana. It is still grossly negligent and irresponsible as hell to have an infant around drugs or drug paraphernalia. When you are an adult, you make your own choices and live with the consequences. You do not have that luxury when you are an infant, and it is the adult's job to make sure the child is safe and taken care of.

For the record, I am part of the "legalize it" crowd. Just the responsible part. Children should not be using or exposed to mind altering drugs (I know the bong was likely empty, still not smart letting a child play with a potentially resin filled bong and/or glass slide which could also be a choking risk). Their brains are not fully formed and they do not yet understand the consequences that can go with poor choices. That is why they are kids and not adults.

The problem is not necessary the illegality (though that is an issue) but more that kids should not be exposed to potentially harmful things.
PS: I know, marijuana is physically safe and has never killed anyone. However, when used irresponbily it is very likely to have a negative effect on the users life.

Cops don't know "you" personally so it does not go without saying that you don't give your child a beer to drink or a bong to puff. If someone posts a photo of what could be conceivably construed as an illegal act, they will be arrested if the police get wind of it. Then they will investigate to determine if the photo is legitimate or not. It takes a real dumb ass to post a photo like that in a public forum.

If it's not harmful to babies in the womb, I'm pretty confident that a little marijuana smoke is leaps and bounds safer than parents who often smoke cigarettes while HOLDING their kids.

A bong is not a drug. The type of drug bongs are used for is relatively benign. Being in the mere vicinity of a plastic bong is not harmful and not just cause for arrest - especially when the kid isn't even old enough to remember the incident.
If this image were used for an anti-drug ad, nobody would give a s**t. It is only being prosecuted because they are unjustly biased against people who toke and don't like the message they think the image represents.

Actually, the statistic that pot has killed zero people is false. The number is in either the single digits or low double digits from the substance itself - negligible compared to tobacco and alcohol, but not zero. I believe they're from something like an allergic reaction.

How does that relate? I get the sense that you missed my point. Doing something illegal, and then posting on facebook is stupid. If you do that, even if its something harmless, and then you get caught then it's your own damn fault. Wanna smoke pot? fine. Wanna pretend your baby smokes pot? Who cares. At least have the good sense, though, not to advertise it to the world. That is the real problem here is just plain stupidity, not bongs and babies.
As far as pirating goes, I agree that is more harmful to society then a baby holding an empty bong. So is pretty much anything. So is littering. I just don't see how that connects with my point.

I guess I was trying to say that I think it's strange that people can brag all over the internet how they break the law when it comes to downloading, but put a staged picture of a baby with a bong on facebook and you get arrested. That doesn't mean I think it was a good idea for her to put said picture on a social network site that connects the picture to her real word information; that was obviously very dumb. I guess I'm not articulating my point very well.

It's at the very least a reason to investigate the woman... right? She has her baby posed in a manner to suggest he or she's taking a bong hit. Her BABY...! Now, you can't tell from the picture whether or not drugs are being used, but once the cops check it out (and get real, they had to check it out), it'd be pretty easy to tell that the pipe has or hasn't been used for in the past. And if it's a crime to have the paraphernalia... why shouldn't she be charged for it?
It's amazing to me how many people are defending this woman. Pot?!? In a negative light?!? That won't help our agenda :) I'm pretty sure it should and will eventually be legalized, but don't defend her. She shouldn't be the pro-pot poster child.

If I might steer this discussion in a serious direction, I make my own alcohol. Completely legal. It has crossed my mind that 21 years is waaaaay too long for a kid to learn properly about the stuff. I managed to stay away until after I was 21, but most kids don't. I'm thinking a small glass of wine with dinner should be normal, and learning what happens if you drink too much should happen at home, not with a bunch of kids at some party.
The law isn't on my side in that regard. :\
