I think that someone decided to copy the Cisco and Apple battle >.> Digg's trademark will not be taken away because this is a social website about articles on the web, and has nothing to do with a retarded game put out by Lucas Arts..
"on that basis they think that digg competes in their arena"And the funny/stupid thing here is that they clearly don't -- digg is a news site, not an entertainment game. And the two aren't even spelled the same ("The Dig" vs "Digg"), even if both were games.
I think it's likely that Digg will prevail since Digg the Internet service clearly does not infringe on the mark The Dig as a computer game. If you look at Digg's trademark application, however, Digg applied for the trademark in two classes: Class 041 and Class 042. On their application, class 041 is described as "Providing online news and information in the field of technology, namely, computer games and computer enhancements for games." Clearly Digg is much more than that now, but at the time of the trademark application in early 2005, Kevin Rose concentrated pretty heavily on gaming and Digg's initial flavor was game-centric. Looked at from that point of view, Digg may have infringed on Lucas' prior trademark on "The Dig" as a computer game. The reality, of course, is that no consumer is going to confuse Digg, the Internet social networking/news service with The Dig the computer game. So it seems to be Digg should prevail - but you can see where Lucas' lawyers are coming from.
Did anyone notice that this was orginally filed in 9/6/06? It looks as if Digg.com filed for extensions and they were granted. It seems someone knows more about this than they are telling? I don't think Lucas Arts plan is to strip Digg.com of it's trademark which is clearly not related to The Dig. I think they are clearly doing what any smart corporation must do to maintain strong trademarks and prevent giving up their rights to their own trademarks. If you don't defend it through the court system you can easily lose almost any rights to the trademark you built up to that point. On the other hand, it's amazing Lucas Arts even cares to keep The Dig trademark alive, however, there are always sequals and gaming has come to the forefront in the world. I wish you good luck and longevity Digg.com!
