eff.org — EFF attorney Fred Von Lohmann explains the legal arguments AACS would make regarding the posting of the key. IT shows just how nasty the DMCA can be. While their argument may not be completely ironclad, they probably would have a case against Digg and any other site that published the code. Everyone involved in this kerfuffle should read this!

I've just encrypted this comment with a complex code. If you break it, you are in direct violation of the DCMA:1+1=Don't even attempt to crack the code above. I'm glad that digg.com is taking a stand as well as google. The DCMA wasn't written with the peoples interests in mind. It's time for a change in the DCMA law. It's time to start making laws that make sense for the people.

This is not a battle anyone needs to fight, simply stop buying these crippled products.Kevin is fine; he's welcome to take a stand. But I think he's been placed in a no-win situation by the diggers, and he can no longer claim a safe harbor provision. The AACS can bring suit, and they may lose, but he will have to spend his company's money to fight it, all because diggers wanted one more place on the internet with this stream of numbers.
