reason.com — Buying gifts and dinners does not get you prosecuted, yet spending an equivalent amount of money in a direct transaction is illegal. As with other victimless crimes, the criminalization of prostitution creates a vast breeding ground for corruption, hypocrisy, and morally dubious law enforcement tactics.

Wow, folks voted me down without actually answering. There is case law in California suggesting that paying a performer for pornography is not prostitution. It is not settled law in most states. If you decide to pay someone to perform a sex act on film, you can be charged with a crime.

Prostitutes charge extra for that and then they want royalties and it all gets very complicated.
