Two main things. Firstly, the HTML Working Group is formally encouraging review from other W3C groups and the public. This publication gives reviewers a stable document to reference. Secondly, WG members now have 150 days to make exclusions under the W3C Patent Policy.

i suppose this is becoming feasable as microsoft is loosing its position as the world wide pimp, rapping the internet into its own ultra low standards
