Let me add that I don't know the answer, but also, as far as I know, no one really has the answer to whether U.S. Courts would necessarily have jurisdiction over something happening in Guantanamo. If I were defending Rumsfeld, that'd be my first argument. The second would probably be qualified immunity. At any rate, I think he can mount a solid defense.What result? I doubt we'll ever know unfortunately. I do think that it'd be a good dose of reality for our political system if someone was actually held accountable for their illegal acts, but from a legal standpoint, if you think you have all the answers here, you're on awfully shaky ground.

You must be kidding me... there will never be charges filled or supported regardless of what he did... If it kept this nation safer then I am all for it... ..... I expect every country in the world would do the exact same...... The UN reminds me of the One Flew Over the Cuckoo's Nest.... one of many waste of our tax payer dollars...

Not sure whether standing is torture. I've stood inside 7Eleven chiller for > 16 hrs (swing + night shift) during Christmas Eve in the city. We had to do it because the crowds were coming in like a Tsunami. But we had protective clothing to prevent frost bites.Waterboarding is torture for sure.

Some died under torture, and that is "murder one" under U.S. law whether the killing was intended or not, because it happened during the commission of a felony.The Bush admin and their lap-dog "Democratic" congress repealed the War Crimes Act in self defense, because their actions prior to its repeal were capital felonies. But you can't repeal basic criminal statutes just to cover a few asses.

Wow... you totally skipped the train of thought didn't you... the first two paragraphs clearly related to your own comments...As far as these "laws"? What laws? I remember some agreements between nations but there is no law higher than a soveriegn nation, unless we're switching to a religious track. If a nation chooses to ignore or bend a treaty, what law-enforcement entity do you think exists? The UN?Please use your noodle before your computer.
