Here we go with the naivity defense again. A judge looks for intent, believe me, he doesn't care about what other uses the site could have....and doesn't.Napster was deemed not legal...and no, it's not JUST like it. Yes, Napster was a native app but it also handled its files ambiguously where as torrents themselves are ambiguous. TPB is VERY much like Napster in that they're trying to profit off of other people's products and in their greed induced blindness have brought themselves to the conclusion that what they're doing is starting a revolution...it's more like they're starting a riot with looting.

Most of those other torrent sites are either a. run on TPB's servers or b. linking to TPB torrent files.

It works like this:The music "industry" is "damaged" because it no longer has "control" over what we listen to. Bribing radio stations has less of an impact. Gift wrapping bands in a box like Linkin Park only goes so far.
