Sounds like common sense to me. If evidence is obtained illegally, then by all means we should punish those responsible for its illegal attainment, but we shouldn't just pretend that it doesn't exist and show it to the courts. If there's evidence, there's evidence, and hiding it doesn't make a criminal it could put away any less guilty, or an innocent man it could exonerate any less innocent.

well, when buying any type of blank media (hdd, dvd disc, flash memory), in my country, I have to pay additional tax which is 6% of the price. This is for the "probably I will write something copyrighted to that dvd, duh"In such case, I find it that I can download anything I want, since I have paid for that. Am I wrong?

I honestly don't believe that that the majority of "pirates" are people just in it to "steal". Some are downloading because they can't afford it; but many people are downloading because they already have paid for it, and need it in a different format. A case in point, Virgin's download service. They are going out of business, and anyone that has bought songs through them will no longer have access to them. They are now advising their customers to burn songs to CD and re-rip them (which is something media companies also cry about). Are those customers wrong for downloading un-DRMed copies of the media they rightfully purchased?

Smoking marijuana is illegal in the United States, but that doesn't mean it is illegal everywhere. It isn't illegal in Amsterdam, so why should people in Amsterdam be arrested for smoking marijuana in their country? That is the same situation as this. Should I be arrested when I return to the United States if I was legally smoking marijuana when I was in Amsterdam? Should Dutch citizens be arrested when they enter the United States for smoking marijuana when they were in the Netherlands?Gambling is illegal in some states, but not all. Should gamblers be arrested for gambling in Nevada?
