No. When you have someone else in the car, they can see that poor sap you're about to run over at the intersection. When you are on the phone, they can't see him.That is why it is different.
That's sort of what I remember my driving instructor bringing up, that a passenger in the car can shut up when you're trying to dive across 6 lanes of traffic to make a left - someone on the phone can't do that and is really a distraction.

It's the talking, Dateline did a whole show on it. Talking itself is enough distraction to make you get in an accident.
