Non-compliant has many levels, you can't just use it as a blanket term without understanding the varying shades underlying that term.If a cop asks me "do you know how fast you were going?" and I refuse to answer, I am non-compliant. Should I be tasered? I pose no risk or threat, so what is the justification? My "non-compliance?"Guns are to be used to defend life and only for that purpose. When used properly, when the officer's or a citizen's life is threatened, there's nothing wrong with that. Tasers are intended for less-than-lethal situations, where the officer or a citizen is threatened with physical harm less than death. Say the guy is charging at you with a stick, or his fists. Using a taser in that situation is perfectly fine. But just because the guy refuses to put his hands behind his back, or to walk over here or there, that's not a proper use for a taser. It is cruel and unusual punishment for a minor act of non-compliance. Cops are supposed to be professional, and should have exceptional situational awareness. A guy turning to go back to his truck, while maybe he's going to get a gun, is still a non-threatening individual. The cop still has control over the situation and can always draw his gun and have it ready to shoot if the guy starts rifling around in his car looking for something, and if he turns with a weapon in hand, can easily shoot him before he actually poses an immediate threat to the officer. The cop will always have control over the situation.This cop simply felt challenged, that this guy did not respect him, so he decided to "show him who's boss", plain and simple.

In other words, the rent-a-cop attacked an unarmed man with a deadly weapon. Of course the bastards settled quickly and out of court. Sorry to hear about that, but I'm happy for him that he hit back where it hurts: their wallets. Isn't tort law a beautiful thing? A really big, eight-figure class action suit against the Taser manufacturer would put a stop to this bulls**t once and for all. Trying to get a District Attorney to preosecute a criminal in uniform is hopeless, but a monster lawsuit would do the trick.
