Jobs is bluffing. Apple is getting bad press so they're trying to defect blame. Apple could implement choice 2 and eliminate the lock-in problem. Jobs just refused in writing and you fell for his ploy.

The answer is simple. In general, people would rather pay and be confident in the ability to find and quickly download any given track or album (in consistently high quality encoding) than not pay and have a craps shoot about if you find the track, what quality it is, and all the while wondering if you're sharing with the RIAA. Ideally, the record companies would see the light, allow distributors to drop DRM and allow the consumer a good product. Until then, they're digging their own grave.

As I mentioned in the Norway response story, licensing Fairplay would play right into the hands of the RIAA. The RIAA wants to divide and conquer all DRM ecosystems so that they can dictate the terms and conditions of any future renewals of the DRM terms and conditions. Apple is too powerful for them to push around and they are trying to use third parties to further their agenda. This push to "license" is not about consumer choice but rather to turn back the clock on consumer usage rights to what it was like before iTMS came along when you could not burn every song you purchased on the other services.The push for variable pricing is also not being done in the interest of the consumer. They want 99 cents to be the lowest price and to price other songs "higher".

how ironic. everybody rails against msft for not being open and altering industry standards. then there is apple and their tidy little fairplay (name is ironic, itself?). i don't own an ipod (gasp, take a breath) for two reasons: proprietary format and the cost.

It's nice to see that some Gurus don't lose faith and leave their roots. All of the giants in the consumer technology industry started as hackers and pirates. It's just interesting that you see Steve still standing up for what he believes in--the consumer--while Bill is out trying to sue Russian school teachers. Way to go Steve!
