Bush cannot be impeached because the Republican Congress gave Bush imperial powers. The John Warner Defense Appropriation Act for Fiscal Year 2007 effectively nullifies the Posse Comitatus Act and the Insurrection Act and gives the President legal means to define under what conditions martial law may be declared and to “employ the armed forces, including the National Guard in Federal service—to restore public order…” On the same day, he also signed the Military Commissions Act of 2006 that allows for the institution of a military alternative to the constitutional justice system.

The Congress may not "give" the President any powers not granted to his office by the Constitution.
