Pre-emptive rebuttal for the trolls:No, if you read TFA it shows this is not about whether waterboarding is torture or not. It's about Torture with a capital T, including the electrodes and other crap in Abu Ghraib. That we have any Supreme Court Justice who doesn't see it as a unconstitutional travesty should make you sick.

Scalia is an enemy of the state because he's an enemy of the Constitution. However even he should not be subject to the same interrogation tactics that he denies are torture.
