No, the status of BSD code was decided in the early 90's. It had a lengthy battle with AT&T, it turned out 16 files out of 3000 derived from Unix tapes distributed when AT&T were banned from selling operating systems. These have all been replaced.

The very fact that SCO did what you suggest is exactly the basis of SOME of IBM's counterclaims. Red Hat also sued SCO, and that case is on hold. Red Hat's case is all about SCO's damage to Linux. (Despite this Linux has done very well in the last four years.)
