Anyone can sue. Can he win? Quite possibly. The poster is already going to be BLACKLISTED from a lot of jobs, owing to the public nature of this.He might as well sue the paper - they were wrong for not supervising Greenbaum well enough. Surely if he had contacted his Legal department first before violating TOS, they would have said no-frickin-way. Greenbaum's wrong does not make a right... but more importantly, he is a loose cannon and I wouldn't trust him in a business. Also - That Greenbaum has to personally delete offensive comments off the site probably speaks volumes... he's MANUALLY doing comment filtering. Hello Greenbaum's boss... 2002 called, and they're laughing that you pay someone to patrol the Comments... the rest of the blogging/newspaper world uses a free or low cost comment filter "service" (like Mollum, etc) to transparently filter offensive posts. This is a second point suggesting the man is incapable of self-supervision.
Half the time someone "resigns" their employer gives them an opportunity to resign instead of being fired, even though you're gone either way. I work in HR. Don't try to punk someone with "Captain Literacy" if you don't know what you're talking about.
Here is a list of every comment he has ever made using that account on Disqus.... He was even talking about how to deal with people's anonymity a few months ago. If you want to get him fired go thru s**t he has said and send it to his work. It is all available to the public online. http://disqus.com/kgreenbaum/#mainThere are only 15 comments or so, but they are about political topics.
