Westy - Your analogy is fundamentally flawed. Under your set of facts, you have already made a sale of the original batch of seeds, so you are not out any money by the purchaser perpetuating his seed-bearing plant. If you were a saavy business person, you would either sell seeds that bear a sterile plant so he would have to return for more seeds, or adjusted your price upward to account for the seed-bearing nature of the plant. In this case, it would be more appropriate of an analogy to imagine said person coming into your field, taking one of your plants, and completely bypassing the need to purchase your seeds in the first place, therefore depriving you of a sale. And you can argue semantics all you like, but when their only other alternative to get the product is to purchase it from you, that's stealing.
