Unibomber, why the anger? are you suggesting that the state should NOT have some sort of limit, albeit somewhat arbitrary, for the amount of alcohol that one can legally have in one's system and still drive? Imagine if the DUI laws tried to take into account the "different tolerences" that people have? How on earth would these different tolerences ever be quantified? It would be largely impossible. Defendents would challenge their cases, arguing that their "tolerances" were improperly measured... and who is to say who is right or wrong, because it would be completely subjective?All laws that rely on some sort of "limit" are arbitrary to some degree. (Like a speed limit. Why 55 mph? Why not 56 mph!?). But that's life. Deal with it. Spend $100 and buy a portable breathalyzer.

Dov,That's my point, it's arbitrary and subjective. Being punished for something as arbitrary and subjective as this pisses me off when it's my life, my money, my time, etc. I don't have a better proposal however, which is why I advocate taking a cab and not overturning the law. It's just my warning to anyone who similarly thinks, possibly rightfully so, that they are fine to drive.

Well, interesting comments. I realize it is widely accepted, to put it mildly, that it is great to have laws against behaviors which could possibly cause harm to someone or another's property. This could be extended to all kinds of behaviors (and will eventually, rest assured) including driving cars. How about if we just criminalize actually doing the harm?
