Quarrion, it's not a legal requirement. But there is what's called "dilution of the trademark" where a trademarks becomes so overused by people other than the trademark holder that the trademark becomes a generic term. Frisbee, Band-Aid, Kleenex, Aspirin, and even Heroin were all trademarks that have become generic terms through trademark dilution. Because of the dilution they are no longer legally protected trademarks. The only way a trademark holder can prevent this from happening is by sending cease-and-desist letters (or suing, etc.). Big companies don't bother having their legal team research each and every case because it would be cost-prohibitive, so they usually end up sending out letters even if they wouldn't win a court case to prevent such use of their trademark (like in this case). But now they have the letters as evidence that they have dutifully tried to protect their trademark, and those letters will help them should they ever have to go to court over the dilution of their trademark. But this is an attempt to censor a piece of information. It's pretty clear what's going on: GBWR is embarrassed by their gaffe (as well they should be) and are trying to get FAIL blog to remove their post that calls them out.There's no trademark infringement. FAIL blog is not claiming to be GBWR and is not passing off GBWR's work as their own.
