arstechnica.com — A judge has refused to award attorneys' fees to an exonerated RIAA defendant after the labels dropped their case against him so they could sue his adult daughter. The question of whether the RIAA should be responsible for fees in such cases may be headed for the Supreme Court.

i have a few articles on my nospintalk.com site. One in particular regards to him and this case. The problem is the supreme court is not even going to hear the case, and a bigger problem is that RIAA, as much as they seem like the devil is within their rights to sue most of these people. The problem comes in with the methods they're using. That's what makes them the scumbags they are.

Not to mention we don't have any of this RIAA bulls**t. No students being sued out of a future here!

It may be obvious but I personally think that the suing party should have to pay for the legal defense of the person being sued if they lose. This would put a huge halt on frivolous lawsuits and it wouldn't ruin the life of the person being sued if they are innocent and it would hurt the person bringing the suit which is good.

If the lawsuit is truly frivolous, we have something known as 'sanctions.' Here the lawsuit was not frivolous. The RIAA had legitimate reason to believe this particular individual was breaking the law. It turned out he was not, but his daughter was. He owes the cost of his successful defense. Am I a fan of the RIAA and it's sturmtruppen tactics? No. Do I respect intellectual property rights? Yes.

Just stay clear of RIAA infected music. There are a few sites that have music from artists operating outside the RIAA dominion. Most of it is better than the gibberish that hits the charts anyway. Haven't bought a single RIAA song for over two years and certainly no downloads because I don't want that cow dung spread. I vote with my money.
