Downloading is not the problem, uploading is. All the precedent thus far in filesharing cases are about uploading content. Due to the fact that you're most always uploading when using bittorrent, its easy for the *AA to go after you. Going after *downloaders* would be a very up-hill battle for the movie studios. Most journalists are too retarded to know the difference and label anyone caught in any kind of P2P trial as being charged with downloading. The article is VERY light on details; I'd be surprised if its not your average copyright infringement case.

I do believe that they have a right to protect what's is their's.However, do they really have to penalize the person their suing more than 1000 times as much as the value of the product they pirated?

Hey I have some good news for you! They've come up with a single word to replace "be aware". Can you believe it? The entire sentiment of "be aware" condensed into a single word. Check it out, I bet it'll be on the front page soon if it isn't already.

First off, it isn't stealing. You are not taking away the movie from the studio. They still have it.Secondly, these people wouldn't have bought the movie anyways. The studios aren't losing potential revenue.

The progress is slow these days but it looks like we might have a catalyst soon.

@clairequiltyReally?They have NO WAY to quantify damages in these cases, as there is no legal way for them to tell:A: Would the person have bought the item anyway had there not been piracy as an optionB: How many times an item was piratedWithout those two items, there is no legally acceptable way for them to determine damages, thus no way to accurately determine penalties.Unless you'd like to point out in our laws where a company can make a claim they can't back up with evidence, and win a case anyway. Want to know why I'm pissed? I'm not a pirate, I'm a sysadmin of several years now and I'm aware of EXACTLY what they can and can't legally get to on a private system. I understand they want to deter criminals, but if you have to ignore other laws to catch these people (and you do) then you are just as bad.

well this tug of war between ethics has been fun and definitly kept me from masterbating or stealing porn . therefore a crime has been commited, I have not recieved a movie from a friend, he did not walk over to my place and we all watched it together, is that going to be a crime soon too ??? if he leaves it at my place am i stealing it, if i give it to another person is that theft? watching it on my tv copies of photons were made, but is it really a copy? what about TIVO and DVR arent they infringing ? hmmm sounds like a system of suck your way in from the start. Short propriteors that start off small like p2p users will always be targeted but we will always outnumber them and leave a better path in our demise.
