A server side check with an phone OS that is cracked open, not much of a challenge without even laying eyes on the code, just block their server access. The only way around that is to force someone to connect to their server at some point or else it will cripple the software, which will cause quite a backlash among touch owners.Not to mention iPhones outside the USA. Remember, we're about the only folks in the world with an "all you can eat" data plan. Everyone else gets metered usage, so people will get very grumpy if a portion of their usage is going towards this.
