Carole Vale, a nurse observing the scene, was also arrested when she asked why Mr. Carnevale was being detained. Mr. Carnevale was held for 22 hours and Ms. Vale was held for 13 hours.

After he drives away in his van?We have the right to ask for a badge number, regardless of whether we're a bystander or the subject of an investigation. It's immensely important for bystanders to be able to question and report officers, because it's not always in the arrestee's best interest to start asking questions. We citizens have the right to look out for each other, just as the police officers look out for each other. You mention that something published in a handbook is not actually law. To me, it sounds like it was only published in the handbook because some officers were forgetting their duty to respond to these questions. This right of citizens has been around a lot longer than the 2003 publish date you gave.Edit: Also, how the hell do you order someone out of the crime scene area in this case? There is no crime, and the scene is an entire section of the city. The citizens had every right to be there, and they had every right to question the officers.

There is no meaningful accountability in NYC against police abuses. The Civilian Complaint Review Board is a meaningless joke, the Mayor's office doesn't seem to care, and the courts generally turn a deaf ear. Without systemic reform, nothing is going to change. On a related note, according to NYC's Public Advocate, only 17% of NYC cops have a college degree (see NY Times letter at <a class="user" href="http://tinyurl.com/33q2lr).">http://tinyurl.com/33q2lr).</a> This is a scary statistic, and probably helps to explain the general ignorance of the law demonstrated by many cops on the street.

Here's a news clue. Something similar happened to me personally almost a dozen years ago now. I was in a cab driven by a minority stopped at a light when from nowhere this cop came up to the driver and claimed he had gone through a red light. Now when you drive a cab getting points for red lights on your license can PUT YOU OUT OF BUSINESS. As a witness to the fact that he did NOT go through the light I told the officer that I would show up in court to defend the cabbie. The cop then and I kid you not WENT FOR ME. I quickly locked the door and ran out the other side. The cab saw where I went but the cop didn't so the cab picked me up at which time I went DIRECTLY to the officers precinct to file a complaint. HOW DARE HE GO FOR ME. I didn't curse at him or anything I just matter of factly told him that I would defend the cabbie as he did nothing wrong. Here's the really sick part. I'm in the cop shop talking to a sargent about what just happened to file a civilian complaint when the cop came in and again WENT FOR ME in the freaking station, can you believe it! One of the other Sargents on duty intercepted him and took him away from me. So not only is this piece totally accurate but it happens all the time.

See, you have no idea how it is to behave around authorities. You are being governed. Sure their are high ideas between the governing and the governed---how the public is supposed to be self governed--but that's an ideal that's not practical. You can't expect every cop to mesh well with the public. Giuliani NYC cops were pretty good, by and large.Their prolly is a problem between people using bike racks as permanent parking spots. With gas prices and NYC being so compact, a lot of people bike-commute. It's not like you can license bikes.The solution here is technology. Just put some lockhinges on the parking posts and put a meter on it. Every hour the lockhinges would unlock. No need for police. Just an extra route for the meter maids.

First let me address the publication to which this misleading Digg has referred to. It is called "Times-Up" <a class="user" href="http://times-up.org/">http://times-up.org/</a> which as a tree-hugging publication, so DUH you're not going to get the full circle of truth. Why was this person arrested? It was not clearly for video taping, familiarize yourself with the law and think of the possibilities that may have led to the arrest - such as Obstructing Governmental Administration (OGA), was it possible that he was interfering with the police? Absolutely! Do you think a police officer would risk his career for not giving his shield number? As for those who state "I asked for a badge number and he refused" BS - the shield number is on the shield and 1" in height. On a summons - his name, tax reg, and summons number is on the top, thus reverts back to the officer. Star Wars? You people need to get out, move out of mommy and daddy?s house, and get LAID! I would say that the vast majority of you would be calling us for help the moment someone gave you a "mean" look, and "hurt" your feelings. If not for the likes of me there would be anarchy in the streets, and no area for free speech. Grow up and start acting as responsible, society contributing adults, most of you if not all happen to be a bunch of whining hypocrites. Yes - I am a retired NYPD police officer (20 Years) - I gave my shield number out on paper every time - and here's one, the department DOESN'T back us up, they would rather fire a cop and parade the pink slip than protect a cop. So before you believe every thing you read, do some investigating - wait they may take some time away from your HALO game.
