They would participate in the newly legalized marijuana market. Just because somebody sells weed, doesn't make them tied to illegal trade.

So your brother needs to moderate his habit. The moral of the story is that prohibition gave the drug dealers the power to kick your brother's ass and possibly kill him. Mom and Pot shops (intended) back in the '30s would kick him out of their store.
