I'll bet you wouldn't have trouble exerting the limited self-control it takes NOT to piss outside if you KNEW you would be branded with the "S" between your eyes for doing it.See? It's quite the effective deterrent!
How is the death penalty cruel? Administered correctly you pass out and then feel nothing more. Cruel isn't the same thing as bad.Being sent to a jail where they know you are likely to be anally raped, be forced to join a racial gang for self defense and always run the risk someone will decide to fight or kill you seems far more cruel to me.I'm not for the death penalty but it isn't cruel in the normal meaning of the word. Of course the 8th ammendment is only vaguely related to the normal uses of the words. For instance the courts stopped the death penalty for awhile in the 70s and if unusual had been about the number of times it is applied it would never have been reinstated. More importantly though the 8th ammendment is understood to include a proportionality requirement. What might be cruel and unusual for one crime may not be for another. I think it is on this base that this punishment is invalid.
