xbox.com— Scratched discs were found in Halo 3 LE. MS admits there is a problem and offers to replace the discs if you are willing to wait two weeks.

It's obviously not intentional, but I don't think it's blown out of proportion. The cases are a piece of junk so the CD falls off the little nub and gets scratched up. It's not THAT unlikely.
I got my LE version on launch. The metal case was dented in on corners on both sides and discs weren't even in their holders...just rolling around in the case with scratches on them. Took it back and exchanged for regular version and got my $10 back. I couldn't even get the picture book out because the case was dented so bad. I thought it was just my luck getting this. Sounds like I wasn't the only one.

Update:Went through about 20 copies at Circuit City--all were damaged. Had to walk home with the "least" damaged copy. :(
